2 | Be it enacted by the People of the State of Illinois, | ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Mental Health and Developmental | ||||||||||||||||||||||||
5 | Disabilities Code is amended by changing Section 1-102 as | ||||||||||||||||||||||||
6 | follows:

8 | Sec. 1-102.
"Care and
and custody" means authorization to | ||||||||||||||||||||||||
9 | an appropriate
person, with his consent, to provide or arrange | ||||||||||||||||||||||||
10 | for proper and adequate
treatment of another person who is | ||||||||||||||||||||||||
11 | subject to involuntary admission but
does not include the | ||||||||||||||||||||||||
12 | authority to require hospitalization of the recipient
unless | ||||||||||||||||||||||||
13 | such authority is expressly granted by court order pursuant to | ||||||||||||||||||||||||
14 | Article
VII of Chapter III. | ||||||||||||||||||||||||
