Bill Title: Creates the Business Mandate Note Act. Provides that every bill the purpose or effect of which is to directly increase the cost of doing business in the State shall have prepared for it, before second reading in the house of introduction, a brief explanatory statement or note that shall include a reliable estimate of the anticipated impact. Provides that the Department of Commerce and Economic Opportunity shall prepare the business mandate note. Provides that the Department shall collect and maintain information on business mandates. Effective immediately.

1 | AMENDMENT TO HOUSE BILL 1084

2 | AMENDMENT NO. ______. Amend House Bill 1084 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Governor's Office of Management and Budget | ||||||
5 | Act is amended by changing Section 2 as follows:
| ||||||
6 | (20 ILCS 3005/2) (from Ch. 127, par. 412)
| ||||||
7 | Sec. 2.
There is created in the executive office of the | ||||||
8 | Governor an Office
to
be known as the Governor's Office of | ||||||
9 | Management and
Budget. The Office shall be headed by a
| ||||||
10 | Director, who shall be appointed by the Governor , by and with | ||||||
11 | the advice and consent of the Senate. The term of office of the | ||||||
12 | Director shall expire on the third Monday of January in odd | ||||||
13 | numbered years provided that he or she shall hold office until | ||||||
14 | a successor is appointed and qualified . | ||||||
15 | Any vacancy in the office of the Director shall be filled | ||||||
16 | pursuant to the provisions of this amendatory Act of the 97th |

1 | General Assembly. In case of a vacancy during the recess of the | ||||||
2 | Senate, the Governor shall make a temporary appointment until | ||||||
3 | the next meeting of the Senate, when the Governor shall | ||||||
4 | nominate a person to fill the office, and any person so | ||||||
5 | nominated who is confirmed by the Senate shall hold office | ||||||
6 | during the remainder of the term and until his or her successor | ||||||
7 | is appointed and qualified. | ||||||
8 | No person shall perform the duties and functions of the | ||||||
9 | Director, or otherwise exercise the authority of the Director, | ||||||
10 | unless he or she has been appointed by the Governor pursuant to | ||||||
11 | this Section. The functions of the
Office shall be as | ||||||
12 | prescribed in Sections 2.1 through 2.7 of
this
Act. | ||||||
13 | On the effective date of this amendatory Act of the 97th | ||||||
14 | General Assembly, the office of Director shall be considered | ||||||
15 | vacant and thereafter shall be filled only pursuant to the | ||||||
16 | provisions of this amendatory Act of the 97th General Assembly.

18 | Section 99. Effective date. This Act takes effect upon | ||||||
19 | becoming law.".
