Bill Title: Amends the Radon Industry Licensing Act. Prohibits any person from selling a device in this State to detect the presence of radon or radon progeny in the indoor atmosphere without prior approval of the device from the Agency. Requires all electronic radon detection devices sold in this State to be calibrated to ensure the accuracy and precision of their measurements of radon and radon progeny. Effective immediately.

1 | AN ACT concerning safety.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Radon Industry Licensing Act is amended by | ||||||
5 | changing Section 25 and by adding Sections 27 and 28 as | ||||||
6 | follows:

7 | (420 ILCS 44/25)
| ||||||
8 | Sec. 25. License requirement. Beginning January 1, 1998, no | ||||||
9 | person
shall sell a device or
perform a service for | ||||||
10 | compensation to detect the presence of radon or radon
progeny | ||||||
11 | in the indoor atmosphere, perform laboratory analysis, or | ||||||
12 | perform a service to reduce the
presence of radon or radon
| ||||||
13 | progeny in the indoor atmosphere unless the
person has been | ||||||
14 | licensed by the
Agency. The application procedures for a | ||||||
15 | license shall be established
by rule of the Agency. This | ||||||
16 | Section does not apply to retail stores that only sell or | ||||||
17 | distribute radon sampling devices but are not engaged in the | ||||||
18 | manufacture of radon sampling devices or a relationship with | ||||||
19 | the client for other services such as home inspection or | ||||||
20 | representation as in a real estate transaction and that do not | ||||||
21 | perform laboratory analysis, measurement, or mitigation | ||||||
22 | services .

2 | Sec. 27. Approval of radon sampling and measurement | ||||||
3 | devices. No person shall sell a device in this State to detect | ||||||
4 | the presence of radon or radon progeny in the indoor atmosphere | ||||||
5 | without prior approval of the device from the Agency. All | ||||||
6 | electronic radon detection devices sold in this State must be | ||||||
7 | calibrated to ensure the accuracy and precision of their | ||||||
8 | measurements of radon and radon progeny.

10 | Sec. 28. Task Force on Radon-Resistant Building Codes. | ||||||
11 | (a) The Radon-Resistant Building Codes Task Force is | ||||||
12 | created. The Task Force consists of the following members: | ||||||
13 | (1) the Director, ex officio, or his or her | ||||||
14 | representative, who is the chair of the Task Force; | ||||||
15 | (2) a representative, designated by the Director, of a | ||||||
16 | home builders' association in Illinois; | ||||||
17 | (3) a representative, designated by the Director, of a | ||||||
18 | home inspectors' association in Illinois; | ||||||
19 | (4) a representative, designated by the Director, of an | ||||||
20 | international building code organization; | ||||||
21 | (5) a representative, designated by the Director, of an | ||||||
22 | Illinois realtors' organization; | ||||||
23 | (6) two representatives, designated by the Director, | ||||||
24 | of respiratory disease organizations, each from a |

1 | different organization; | ||||||
2 | (7) a representative, designated by the Director, of a | ||||||
3 | cancer research and prevention organization; | ||||||
4 | (8) a representative, designated by the Director, of a | ||||||
5 | municipal organization in Illinois; | ||||||
6 | (9) one person appointed by the Speaker of the House of | ||||||
7 | Representatives; | ||||||
8 | (10) one person appointed by the Minority Leader of the | ||||||
9 | House of Representatives; | ||||||
10 | (11) one person appointed by the President of the | ||||||
11 | Senate; and | ||||||
12 | (12) one person appointed by the Minority Leader of the | ||||||
13 | Senate. | ||||||
14 | (b) The Task Force shall meet at the call of the chair. | ||||||
15 | Members shall serve without compensation, but may be reimbursed | ||||||
16 | for their reasonable expenses from moneys appropriated for that | ||||||
17 | purpose. The Agency shall provide staff and support for the | ||||||
18 | operation of the Task Force. | ||||||
19 | (c) The Task Force shall make recommendations to the | ||||||
20 | Governor, the Agency, the Environmental Protection Agency, and | ||||||
21 | the Pollution Control Board concerning the adoption of rules | ||||||
22 | for building codes.

23 | Section 99. Effective date. This Act takes effect upon | ||||||
24 | becoming law.
