Bill Title: Amends the Illinois Vehicle Code. Provides that a person or entity may not use an electronic tracking device to determine the location or movement of a person. Exempts from the new provisions (1) situations where the registered owner, lessor, or lessee of a vehicle has consented to the use of the electronic tracking device; and (2) the lawful use of an electronic tracking device by a law enforcement agency. Provides that a violation of the new provisions is a Class A misdemeanor.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Vehicle Code is amended by adding | |||||||||||||||||||
5 | Section 11-1435 as follows:

6 | (625 ILCS 5/11-1435 new) | |||||||||||||||||||
7 | Sec. 11-1435. Electronic tracking devices prohibited. | |||||||||||||||||||
8 | (a) A person or entity in this State may not use an | |||||||||||||||||||
9 | electronic tracking device to determine the location or | |||||||||||||||||||
10 | movement of a person. As used in this Section, "electronic | |||||||||||||||||||
11 | tracking device" means any device attached to a vehicle or | |||||||||||||||||||
12 | other moveable thing that reveals its location or movement by | |||||||||||||||||||
13 | the transmission of electronic signals. | |||||||||||||||||||
14 | (b) This Section does not apply: | |||||||||||||||||||
15 | (1) when the registered owner, lessor, or lessee of a | |||||||||||||||||||
16 | vehicle has consented to the use of the electronic tracking | |||||||||||||||||||
17 | device with respect to that vehicle; or | |||||||||||||||||||
18 | (2) to the lawful use of an electronic tracking device | |||||||||||||||||||
19 | by a law enforcement agency. | |||||||||||||||||||
20 | (c) A violation of this Section is a Class A misdemeanor.
