Bill Title: Amends the Illinois Municipal Code. Provides that if foreclosure proceedings for a residential building have been commenced, it is the responsibility of the mortgagee, judgment creditor, or other lien holder to adequately heat the residential building to prevent frozen pipes.

2 | AMENDMENT NO. ______. Amend House Bill 1250, on page 1, | ||||||
3 | line 1, by replacing "local government" with "civil law"; and

4 | on page 1, by replacing lines 4 through 11 with the following:

5 | "Section 5. The Code of Civil Procedure is amended by | ||||||
6 | adding Section 15-1701.5 as follows:

7 | (735 ILCS 5/15-1701.5 new) | ||||||
8 | Sec. 15-1701.5. Foreclosure; frozen pipe prevention. If | ||||||
9 | the foreclosure of residential real estate has commenced and | ||||||
10 | the property is unoccupied, the mortgagee in possession, or a | ||||||
11 | creditor or other lien holder in possession pursuant to court | ||||||
12 | order, must winterize the
residential real estate to prevent | ||||||
13 | frozen pipes. ".
