| ||||||
2 | AMENDMENT NO. ______. Amend House Bill 1957 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The School Code is amended by changing Section | ||||||
5 | 34-210 and by adding Section 34-232 as follows:
| ||||||
6 | (105 ILCS 5/34-210) | ||||||
7 | Sec. 34-210. The Educational Facility Master Plan. | ||||||
8 | (a) In accordance with the schedule set forth in this | ||||||
9 | Article, the chief executive officer or his or her designee | ||||||
10 | shall prepare a 10-year educational facility master plan every | ||||||
11 | 5 years, with updates 2 1/2 years after the approval of the | ||||||
12 | initial 10-year plan, with the first such educational facility | ||||||
13 | master plan to be approved on or before January 1, 2014 July 1, | ||||||
14 | 2013 . | ||||||
15 | (b) The educational facility master plan shall provide | ||||||
16 | community area level plans and individual school master plans |

1 | with options for addressing the facility and space needs for | ||||||
2 | each facility operated by the district over a 10-year period. | ||||||
3 | (c) The data, information, and analysis that shall inform | ||||||
4 | the educational facility master plan shall be published on the | ||||||
5 | district's Internet website and shall include the following: | ||||||
6 | (1) a description of the district's guiding | ||||||
7 | educational goals and standards; | ||||||
8 | (2) a brief description of the types of instructional | ||||||
9 | programs and services delivered in each school; | ||||||
10 | (3) a description of the process, procedure, and | ||||||
11 | timeline for community participation in the development of | ||||||
12 | the plan; | ||||||
13 | (4) the enrollment capacity of each school and its rate | ||||||
14 | of utilization; | ||||||
15 | (5) a report on the assessment of individual building | ||||||
16 | and site conditions; | ||||||
17 | (6) a data table with historical and projected | ||||||
18 | enrollment data by school by grade; | ||||||
19 | (7) community analysis, including a study of current | ||||||
20 | and projected demographics, land usage, transportation | ||||||
21 | plans, residential housing and commercial development, | ||||||
22 | private schools, plans for water and sewage service | ||||||
23 | expansion or redevelopment, and institutions of higher | ||||||
24 | education; | ||||||
25 | (8) an analysis of the facility needs and requirements | ||||||
26 | of the district; and |

1 | (9) identification of potential sources of funding for | ||||||
2 | the implementation of the Educational Facility Master | ||||||
3 | Plan. | ||||||
4 | (d) On or before July 1, 2013 January 1, 2013 , the chief | ||||||
5 | executive officer or his or her designee shall prepare and | ||||||
6 | distribute for comment a preliminary draft of the Educational | ||||||
7 | Facility Master Plan. The draft plan shall be distributed to | ||||||
8 | the City of Chicago, the County of Cook, the Chicago Park | ||||||
9 | District, the Chicago Housing Authority, the Chicago Transit | ||||||
10 | Authority, attendance centers operated by the district, and | ||||||
11 | charter schools operating within the district. Each attendance | ||||||
12 | center shall make the draft plan available to the local school | ||||||
13 | council or alternative advisory body and to the parents, | ||||||
14 | guardians, and staff of the school. The draft plan also shall | ||||||
15 | be distributed to each State Senator and State Representative | ||||||
16 | with a district in the City of Chicago, to the Mayor of the | ||||||
17 | City of Chicago, and to each alderman of the City. | ||||||
18 | (e) The chief executive or his or her designee shall | ||||||
19 | publish a procedure for conducting public hearings and | ||||||
20 | submitting public comments on the draft plan. | ||||||
21 | (f) After consideration of public input on the draft plan, | ||||||
22 | the chief executive officer or his or her designee shall | ||||||
23 | prepare and publish a report describing the process used to | ||||||
24 | incorporate public input in the development of the final plan | ||||||
25 | to be recommended to the Board. | ||||||
26 | (g) The chief executive officer shall present the final |

1 | plan and report to the Board for final consideration and | ||||||
2 | approval. | ||||||
3 | (h) The final approved Educational Facility Master Plan | ||||||
4 | shall be published on the district's website. | ||||||
5 | (i) No later than January 1, 2016, and every 5 years | ||||||
6 | thereafter, the chief executive officer or his or her designee | ||||||
7 | shall prepare and submit for public comment a draft revised | ||||||
8 | Educational Facility Master Plan following the procedures | ||||||
9 | required for development of the original plan. | ||||||
10 | (j) This proposed revised plan shall reflect the progress | ||||||
11 | achieved during the first 2 1/2 years of the Educational | ||||||
12 | Facility Master Plan.

14 | (105 ILCS 5/34-232 new) | ||||||
15 | Sec. 34-232. Proposed school action announcement and | ||||||
16 | notice; 2012-2013 school year. The following apply for school | ||||||
17 | actions proposed during the 2012-2013 school year: | ||||||
18 | (1) On or before March 31, 2013, the chief executive | ||||||
19 | officer shall announce all proposed school actions to be | ||||||
20 | taken at the close of the current academic year consistent | ||||||
21 | with the guidelines published under Section 34-230 of this | ||||||
22 | Code. | ||||||
23 | (2) On or before March 31, 2013, the chief executive | ||||||
24 | officer shall publish notice of the proposed school | ||||||
25 | actions. |

1 | (3) The chief executive officer shall provide notice of | ||||||
2 | proposed school actions at least 15 calendar days in | ||||||
3 | advance of a public hearing or meeting. | ||||||
4 | All other provisions of Section 34-230 of this Code that do | ||||||
5 | not conflict with this Section must be followed when proposing | ||||||
6 | school actions.

7 | Section 99. Effective date. This Act takes effect upon | ||||||
8 | becoming law.".
