1 AN ACT concerning business.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2TTT as follows:
6 (815 ILCS 505/2TTT new)
7 Sec. 2TTT. Contact lenses; unilateral pricing policies
8prohibited. It is an unlawful practice under this Act for a
9manufacturer or distributor of prescription contact lenses to:
10 (1) prevent, by any means, including through a
11 unilateral policy or agreement, any retailer from selling
12 or advertising contact lenses to consumers below any
13 specified price or to otherwise limit the ability of any
14 retailer to determine prices at which contact lenses are
15 offered or advertised to consumers; or
16 (2) restrict options available to contact lens
17 consumers by discriminating in the distribution of contact
18 lenses based upon the channel of trade or based upon
19 whether the retailer is, or is associated with, a person or
20 entity, authorized by law to prescribe contact lenses.
