Bill Title: Amends the Food Handling Regulation Enforcement Act. Provides that all food service establishments shall have at least one certified food service sanitation manager who has undergone training that follows nationally recognized industry standards for allergen safety and allergen awareness available on the premises at all times that the food service establishment is in operation. Provides that all individuals seeking food service sanitation manager certification or food service sanitation manager recertification shall undergo training that follows nationally recognized industry standards for allergen safety and allergen awareness. Provides that any costs for the allergen safety and allergen awareness training shall be borne by the individual seeking the training. Effective immediately.

1 | AN ACT concerning health.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Food Handling Regulation Enforcement Act is | ||||||||||||||||||||||||
5 | amended by changing Section 3 as follows:

7 | Sec. 3.
Each food service establishment shall be under the | ||||||||||||||||||||||||
8 | operational
supervision of a certified food service sanitation | ||||||||||||||||||||||||
9 | manager in accordance
with rules promulgated under this Act.

10 | By July 1, 1990, the Director of the Department of Public | ||||||||||||||||||||||||
11 | Health in
accordance with this Act, shall
promulgate rules for | ||||||||||||||||||||||||
12 | the education, examination, and certification of food
service | ||||||||||||||||||||||||
13 | establishment managers and instructors of the food service
| ||||||||||||||||||||||||
14 | sanitation manager certification education programs. Beginning | ||||||||||||||||||||||||
15 | July 1, 2014, any individual seeking a food service sanitation | ||||||||||||||||||||||||
16 | manager certificate or a food service sanitation manager
| ||||||||||||||||||||||||
17 | instructor certificate must complete a minimum of 8 hours of | ||||||||||||||||||||||||
18 | Department-approved training, inclusive of the examination, | ||||||||||||||||||||||||
19 | and receive a passing score on the examination set by the | ||||||||||||||||||||||||
20 | certification exam provider accredited under standards | ||||||||||||||||||||||||
21 | developed and adopted by the Conference for Food Protection or | ||||||||||||||||||||||||
22 | its successor organization. A food service
sanitation manager | ||||||||||||||||||||||||
23 | certificate and a food service sanitation manager

1 | certificate shall be valid for 5 years, unless revoked by the
| ||||||
2 | Department of Public Health, and shall not be transferable from | ||||||
3 | the
individual to whom it was issued. Beginning July 1, 2014, | ||||||
4 | recertification for food service sanitation manager | ||||||
5 | certification shall be accomplished by
presenting evidence of | ||||||
6 | completion of 8 hours of Department-approved training, | ||||||
7 | inclusive of the examination, and having received a passing | ||||||
8 | score on the examination set by the certification exam provider | ||||||
9 | accredited under standards developed and adopted by the | ||||||
10 | Conference for Food Protection or its successor organization. | ||||||
11 | In addition to the other training requirements of this Section, | ||||||
12 | all individuals seeking food service sanitation manager | ||||||
13 | certification or food service sanitation manager | ||||||
14 | recertification shall undergo training that follows nationally | ||||||
15 | recognized industry standards for allergen safety and allergen | ||||||
16 | awareness. Any costs for the allergen safety and allergen | ||||||
17 | awareness training shall be borne by the individual seeking the | ||||||
18 | training. All food service establishments shall have at least | ||||||
19 | one certified food service sanitation manager trained in | ||||||
20 | allergen safety and allergen awareness available at all times | ||||||
21 | that the food service establishment is in operation.

22 | For purposes of certification and recertification for food | ||||||
23 | service sanitation manager certification, the Department shall | ||||||
24 | accept only training approved by the Department and | ||||||
25 | certification exams accredited under standards developed and | ||||||
26 | adopted by the Conference for Food Protection or its successor.

1 | The Department shall charge
a fee of $35 for each new and | ||||||
2 | renewed food service sanitation manager
certificate and $10 for | ||||||
3 | each replacement certificate.
All fees collected
under this | ||||||
4 | Section shall be deposited into the Food and Drug Safety Fund.
| ||||||
5 | Any
fee received by the Department under this Section that | ||||||
6 | is submitted for the
renewal of an expired food service | ||||||
7 | sanitation manager certificate may be
returned by the Director | ||||||
8 | after recording the receipt of the fee and the reason
for its | ||||||
9 | return.
| ||||||
10 | The Department shall award an Illinois certificate to | ||||||
11 | anyone presenting a valid certificate issued by another state, | ||||||
12 | so long as the holder of the certificate provides proof of | ||||||
13 | having passed an examination accredited under standards | ||||||
14 | developed and adopted by the Conference for Food Protection or | ||||||
15 | its successor. The $35 issuance fee applies. The reciprocal | ||||||
16 | Illinois certificate shall expire on the same date as the | ||||||
17 | presented certificate. On or before the expiration date, the | ||||||
18 | holder must have met the Illinois recertification requirements | ||||||
19 | in order to be reissued an Illinois certificate. Reciprocity is | ||||||
20 | only for individuals who have moved to or begun working in | ||||||
21 | Illinois in the 6 months prior to applying for reciprocity. Any | ||||||
22 | individual presenting an out-of-state certificate may do so | ||||||
23 | only once. | ||||||

25 | Section 99. Effective date. This Act takes effect upon | ||||||
26 | becoming law.
