1 | AN ACT concerning health.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:

4 | Section 5. The Department of Public Health Powers and | ||||||
5 | Duties Law of the
Civil Administrative Code of Illinois is | ||||||
6 | amended by changing Section 2310-650 as follows:

7 | (20 ILCS 2310/2310-650) | ||||||
8 | Sec. 2310-650. Influenza vaccination program. | ||||||
9 | (a) As used in this Section, "medically contraindicated" | ||||||
10 | means that administration of an influenza vaccine to an | ||||||
11 | employee would likely be detrimental to the employee's health. | ||||||
12 | (b) The Department of Public Health may require any | ||||||
13 | facility licensed by the Department to implement an influenza | ||||||
14 | vaccination program that ensures that the employees of the | ||||||
15 | facility are offered the opportunity to be vaccinated against | ||||||
16 | seasonal influenza and any other novel or pandemic influenza | ||||||
17 | viruses as vaccines become available. The Department may adopt | ||||||
18 | rules setting forth the requirements of the influenza | ||||||
19 | vaccination program. A health care employee may decline the | ||||||
20 | offer of vaccination if the vaccine is medically | ||||||
21 | contraindicated, if the vaccination is against the employee's | ||||||
22 | religious beliefs, or if the employee has already been | ||||||
23 | vaccinated. General philosophical or moral reluctance to |

2 | an exemption.

4 | Section 99. Effective date. This Act takes effect July 1, | ||||||
