1    AN ACT concerning local government.
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4    Section 5. The Public Officer Prohibited Activities Act is
5amended by changing Section 1 as follows:
6    (50 ILCS 105/1)    (from Ch. 102, par. 1)
7    Sec. 1. County board. No member of a county board, during
8the term of office for which he or she is elected, may be
9appointed to, accept, or hold any office other than (i)
10chairman of the county board or member of the regional
11planning commission by appointment or election of the board of
12which he or she is a member, (ii) alderperson of a city or
13member of the board of trustees of a village or incorporated
14town if the city, village, or incorporated town has fewer than
151,000 inhabitants and is located in a county having fewer than
1650,000 inhabitants, or (iii) trustee of a forest preserve
17district created under Section 18.5 of the Conservation
18District Act, unless he or she first resigns from the office of
19county board member or unless the holding of another office is
20authorized by law. Any such prohibited appointment or election
21is void. This Section shall not preclude a member of the county
22board from being appointed or selected to serve as (i) a member
23of a County Extension Board as provided in Section 7 of the

1County Cooperative Extension Law, (ii) a member of an
2Emergency Telephone System Board as provided in Section 15.4
3of the Emergency Telephone System Act, (iii) a member of the
4board of review as provided in Section 6-30 of the Property Tax
5Code, or (iv) a public administrator or public guardian as
6provided in Section 13-1 of the Probate Act of 1975, or (v) a
7member of an intergovernmental joint self-insurance pool board
8as provided in Section 6 of the Intergovernmental Cooperation
9Act. Nothing in this Act shall be construed to prohibit an
10elected county official from holding elected office in another
11unit of local government so long as there is no contractual
12relationship between the county and the other unit of local
13government. This amendatory Act of 1995 is declarative of
14existing law and is not a new enactment.

16    Section 99. Effective date. This Act takes effect upon
17becoming law.
