Bill Title: Amends the Illinois Highway Code. Provides that the Department of Transportation shall construct a private entrance on Business Route 72, west of Woods Lane, east of State Route 104, on the south side of the road. Effective immediately.

1 | AN ACT concerning transportation.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Illinois Highway Code is amended by changing | |||||||||||||||||||
5 | Section 4-210 as follows:
| |||||||||||||||||||

7 | Sec. 4-210.
Except where the right of access has been | |||||||||||||||||||
8 | limited by or
pursuant to law every owner or occupant of | |||||||||||||||||||
9 | property abutting upon any State
highway shall have reasonable | |||||||||||||||||||
10 | means of ingress from and egress to the State
highway | |||||||||||||||||||
11 | consistent with the use being made of such property and not
| |||||||||||||||||||
12 | inconsistent with public safety or with the proper construction | |||||||||||||||||||
13 | and
maintenance of the State highway for purposes of travel, | |||||||||||||||||||
14 | drainage and other
appropriate public use. The Department is | |||||||||||||||||||
15 | authorized to adopt and to amend
reasonable and necessary | |||||||||||||||||||
16 | rules, regulations and specifications covering
standard | |||||||||||||||||||
17 | entrance or exit driveways to serve residential, farm, | |||||||||||||||||||
18 | commercial,
industrial, and roadside service establishments | |||||||||||||||||||
19 | and other uses of property
abutting upon State highways | |||||||||||||||||||
20 | including specifications for drainage and
other structures | |||||||||||||||||||
21 | appurtenant to such driveways. No permit shall be issued
by the | |||||||||||||||||||
22 | Department for the construction of any such driveway which does | |||||||||||||||||||
23 | not
conform to the applicable standard prescribed by the |

1 | Department unless the
application therefor is accompanied by | ||||||
2 | drawings of and specifications for
the proposed construction | ||||||
3 | and a showing of reasonable need for departure
from the | ||||||
4 | applicable standard type of driveway prescribed by the | ||||||
5 | Department
nor unless it is made to appear that the proposed | ||||||
6 | construction and the use
thereof will not be inconsistent with | ||||||
7 | public safety and use nor with the
proper construction and | ||||||
8 | maintenance of the highway and its drainage and
other | ||||||
9 | facilities.

10 | The Department shall construct a private entrance on | ||||||
11 | Business Route 72, west of Woods Lane, east of State Route 104, | ||||||
12 | on the south side of the road. | ||||||
