Bill Title: Amends the Illinois Municipal Code. Provides that a municipality may not use points systems, quotas, or any related process that tracks or accounts for the number of citations or warnings issued by a police officer. Provides that the number of traffic stops completed and written warnings are not included (currently, are included) in the definition of "points of contact". Effective immediately.

1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Municipal Code is amended by | ||||||||||||||||||||||||
5 | changing Section 11-1-12 as follows:

6 | (65 ILCS 5/11-1-12) | ||||||||||||||||||||||||
7 | Sec. 11-1-12. Quotas prohibited. A municipality may not | ||||||||||||||||||||||||
8 | require a police officer to issue a specific number of | ||||||||||||||||||||||||
9 | citations within a designated period of time. A municipality | ||||||||||||||||||||||||
10 | may not use points systems, quotas, or any related process | ||||||||||||||||||||||||
11 | that tracks or accounts for the number of citations or | ||||||||||||||||||||||||
12 | warnings issued by a police officer. This prohibition shall | ||||||||||||||||||||||||
13 | not affect the conditions of any federal or State grants or | ||||||||||||||||||||||||
14 | funds awarded to the municipality and used to fund traffic | ||||||||||||||||||||||||
15 | enforcement programs. | ||||||||||||||||||||||||
16 | A municipality may not, for purposes of evaluating a | ||||||||||||||||||||||||
17 | police officer's job performance, compare the number of
| ||||||||||||||||||||||||
18 | citations issued by the police officer
to the number of | ||||||||||||||||||||||||
19 | citations issued by any other police officer who has similar | ||||||||||||||||||||||||
20 | job duties. Nothing in this Section shall prohibit a | ||||||||||||||||||||||||
21 | municipality from evaluating a police officer based on the | ||||||||||||||||||||||||
22 | police officer's points of contact. For the purposes of this | ||||||||||||||||||||||||
23 | Section, "points of contact" means any quantifiable contact |

1 | made in the furtherance of the police officer's duties, | ||||||
2 | including, but not limited to, the number of traffic stops | ||||||
3 | completed, arrests , written warnings, and crime prevention | ||||||
4 | measures. " Points of contact " shall not include either the | ||||||
5 | issuance of citations or the number of citations issued , the | ||||||
6 | number of traffic stops completed, or written warnings issued | ||||||
7 | by a police officer. | ||||||
8 | A home rule municipality may not establish requirements | ||||||
9 | for or assess the performance of police officers in a manner | ||||||
10 | inconsistent with this Section. This Section is a denial and | ||||||
11 | limitation of home rule powers and functions under subsection | ||||||
12 | (g) of Section 6 of Article VII of the Illinois Constitution.
