Bill Title: Amends the Electric Vehicle Rebate Act. Defines "electric bicycle" and "nonattainment area". Provides that, beginning July 1, 2024, and continuing as long as funds are available, a person may apply for a rebate following the purchase of an electric bicycle in the State. Provides for a schedule of rebates awarded. Provides for a secondary schedule of rebates awarded for individuals who can provide proof of eligibility for the Food Assistance for Women, Infants, and Children, the Supplemental Nutrition Assistance Program, the Supplemental Low-Income Energy Assistance, or otherwise make less than 300% of the federal poverty limit. Provides that a community shall be prioritized for the electric bicycle rebate program if the community is within a nonattainment area. Provides that the incentive for a rebate for an electric bicycle shall be available at the point of sale in order to maximize the impact for low-income and mid-income communities. Provides that a business in a nonattainment area shall register with the Department of Revenue to directly receive rebates for the business' sales with the retailer collecting specified information.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Electric Vehicle Rebate Act is amended by | |||||||||||||||||||||
5 | changing Section 10 and by adding Section 50 as follows:

7 | Sec. 10. Definitions. As used in this Act:
| |||||||||||||||||||||
8 | "Agency" means the Environmental Protection Agency.
| |||||||||||||||||||||
9 | "Covered Area" means the counties of Cook, DuPage, Kane, | |||||||||||||||||||||
10 | Lake, McHenry, and
Will, the townships of Aux Sable and Goose | |||||||||||||||||||||
11 | Lake in Grundy County, and the township of Oswego in Kendall | |||||||||||||||||||||
12 | County. | |||||||||||||||||||||
13 | "Electric bicycle" means a bicycle equipped with an | |||||||||||||||||||||
14 | electric motor that may be activated in order to assist with or | |||||||||||||||||||||
15 | replace pedaling.

16 | "Electric vehicle" means a vehicle that is exclusively | |||||||||||||||||||||
17 | powered by and refueled by electricity, must be plugged in to | |||||||||||||||||||||
18 | charge, and is licensed to drive on public roadways. "Electric | |||||||||||||||||||||
19 | Vehicle" does not include electric bicycles, electric mopeds, | |||||||||||||||||||||
20 | electric off-highway vehicles, or hybrid electric vehicles and | |||||||||||||||||||||
21 | extended-range electric vehicles that are also equipped with | |||||||||||||||||||||
22 | conventional fueled propulsion or auxiliary engines. | |||||||||||||||||||||
23 | "Environmental justice community" has the same meaning, |

1 | based on existing methodologies and findings, used and as may | ||||||
2 | be updated by the Illinois Power Agency and its Program | ||||||
3 | Administrator of the Illinois Solar for All Program. | ||||||
4 | "Low income" means persons and families whose income does
| ||||||
5 | not exceed 80% of the State median income for the current State | ||||||
6 | fiscal year, as established by the United States Department of | ||||||
7 | Health and Human Services. | ||||||
8 | "Nonattainment area" means an area of the State that the | ||||||
9 | United States Environmental Protection Agency has designated | ||||||
10 | as being in nonattainment with a national ambient air quality | ||||||
11 | standard.

14 | Sec. 50. Electric bicycle rebate. | ||||||
15 | (a) Beginning July 1, 2024, and continuing as long as | ||||||
16 | funds are available, a person may apply to the Agency for a | ||||||
17 | rebate following the retail purchase of an electric bicycle in | ||||||
18 | the State. Subject to appropriation, the Agency shall, upon | ||||||
19 | receiving proof of the retail purchase of the electric bicycle | ||||||
20 | in the State, award the purchaser a rebate under this Section | ||||||
21 | in the amount of: | ||||||
22 | (1) $750 for an electric bicycle sold to the retail | ||||||
23 | purchaser for $1,750 or less; | ||||||
24 | (2) $500 for an electric bicycle sold to the retail | ||||||
25 | purchaser for more than $1,750 but less than $4,000; and |

1 | (3) $250 for an electric bicycle sold to the retail | ||||||
2 | purchaser for at least $4,000 but less than $5,000. | ||||||
3 | (b) There shall be a secondary schedule for individuals | ||||||
4 | who can provide proof of eligibility for the for Food | ||||||
5 | Assistance for Women, Infants, and Children Program, the | ||||||
6 | Supplemental Nutrition Assistance Program, or the Supplemental | ||||||
7 | Low-Income Energy Assistance Program or whose household income | ||||||
8 | is not greater than 300% of the federal poverty guidelines | ||||||
9 | updated periodically in the Federal Register by the United | ||||||
10 | States Department of Health and Human Services under the | ||||||
11 | authority of 42 U.S.C. 9902(2). Under that schedule, a $1,000 | ||||||
12 | rebate would be provided for the first $2,000 spent. every | ||||||
13 | dollar after up to $5,000. This calculation would give a | ||||||
14 | maximum of $2,000 for a purchase of $5,000 and more. | ||||||
15 | (c) If a community is located within a nonattainment area | ||||||
16 | in the State, then purchasers from that community shall be | ||||||
17 | prioritized for the electronic bicycle rebate program | ||||||
18 | established in subsection (a). | ||||||
19 | (d) The incentive for a rebate for an electronic bicycle | ||||||
20 | under subsection (a) shall be available at the point of sale in | ||||||
21 | order to maximize the impact for low and mid-income | ||||||
22 | communities. A business in a nonattainment area as determined | ||||||
23 | by the United States Environmental Protection Agency shall | ||||||
24 | register with the Department of Revenue to directly receive | ||||||
25 | rebates for the business' sale with the retailer collecting | ||||||
26 | the following information: voucher number; employee name; |

1 | bicycle manufacturer; bicycle model; bicycle serial number; | ||||||
2 | rebate amount; total bicycle cost; and any other information | ||||||
3 | the Department of Revenue would need to provide a rebate to the | ||||||
4 | retailer.
