1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Fireworks Regulation Act of Illinois is
5amended by changing Section 2 as follows:
6 (425 ILCS 30/2) (from Ch. 127 1/2, par. 102)
7 Sec. 2. The following words and phrases, when used in this
8Act, shall for the purpose of this Act have the following
9definition and meaning:
10 (a) The term fireworks shall mean and include any explosive
11composition or any substance or combination of substances, or
12article prepared for the purpose of producing a visible or
13audible effect of a temporary exhibitional nature by explosion,
14combustion, deflagration or detonation, and shall include
15blank cartridges, toy cannons in which explosives are used, the
16type of balloons which require fire underneath to propel the
17same, firecrackers, torpedoes, sky rockets, Roman candles,
18bombs or other fireworks of like construction and any fireworks
19containing any explosive compound; or any tablets or other
20device containing any explosive substance, or containing
21combustible substances producing visual effects. The term
22"fireworks" shall not include snake or glow worm pellets; smoke
23devices; sparklers; trick noisemakers known as "party

1poppers", "booby traps", "snappers", "trick matches",
2"cigarette loads" and "auto burglar alarms"; toy pistols, toy
3canes, toy guns, or other devices in which paper or plastic
4caps containing twenty-five hundredths grains or less of
5explosive compound are used, provided they are so constructed
6that the hand cannot come in contact with the cap when in place
7for the explosion; firecrackers, sky rockets, or Roman candles;
8and toy pistol paper or plastic caps which contain less than
9twenty-five hundredths grains of explosive mixture; the sale
10and use of which shall be permitted at all times.
11 (b) The term "fireworks plant" shall mean and include all
12lands, with buildings thereon, used in connection with the
13manufacture or processing of fireworks, as well as storehouses
14located thereon for the storage of finished fireworks.
15 (c) The term "fireworks factory building" shall mean any
16building or other structure in which the manufacture of
17fireworks, or in which any processing involving fireworks is
18carried on.
19 (d) The term "magazine" shall mean any building or other
20structure used for the storage of explosive raw materials used
21in the manufacture of fireworks.
22 (e) The term "Office" shall mean the Office of the State
23Fire Marshal.
