Bill Title: Amends the Illinois Municipal Code. Provides that the corporate authorities of any municipality may establish a database and require businesses located within the municipality to register with the municipality and be listed on the database. Provides that no registration fees shall be charged, and the database shall be a public record subject to The Freedom of Information Act. Further provides that a municipality may charge any business that fails to register a penalty of up to $200. Limits the concurrent exercise of home rule powers. Effective immediately.

AMENDMENT TO HOUSE BILL 4018
2 AMENDMENT NO. ______. Amend House Bill 4018 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Municipal Code is amended by
5adding Section 11-1-12 as follows:
6 (65 ILCS 5/11-1-12 new)
7 Sec. 11-1-12. Registered businesses. The corporate
8authorities of any municipality may establish a registry and
9require businesses located within the municipality to register
10with the municipality. An established registry may only include
11the (i) business owner's name and business address, (ii)
12business and emergency phone numbers, (iii) e-mail address of
13the business, (iv) internet website address, and (v) nature of
14the business. The corporate authorities of a municipality must
15notify businesses of the registration requirement. If a
16business has received at least 2 notifications of the

1registration requirement, then the corporate authorities of a
2municipality may charge a maximum penalty of $200 for failure
3to register with the municipality. If a municipality creates a
4database containing information from the registry created
5under this Section, then the database shall be a public record
6subject to The Freedom of Information Act. This Section does
7not limit a home rule municipality's ability to license
8businesses for a fee and enact regulations for that system of
9licensure.
10 Section 99. Effective date. This Act takes effect upon
11becoming law.".
