Bill Title: Amends the Illinois Governmental Ethics Act. Provides that a "late term appointee" also means a person who is appointed to an office by a board or other body having one or more members appointed by the Governor, when the Governor does not succeed himself or herself as Governor, and the effective date of the appointment is 90 or fewer days before the end of the appointing Governor's term. Provides that the provision added by the amendatory Act does not apply to a board or other body to which the Attorney General, Secretary of State, Comptroller, or Treasurer also appoints one or more members. Effective immediately.

1 | AN ACT concerning government.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Governmental Ethics Act is amended | |||||||||||||||||||
5 | by changing Section 3A-5 as follows:

6 | (5 ILCS 420/3A-5)

7 | Sec. 3A-5. Definitions. As used in this Article:
| |||||||||||||||||||
8 | "Late term appointee" means a person who is appointed to an | |||||||||||||||||||
9 | office : (1) by
a Governor who does not succeed himself or | |||||||||||||||||||
10 | herself as Governor, whose
appointment requires the advice and | |||||||||||||||||||
11 | consent of the Senate, and whose
appointment is confirmed by | |||||||||||||||||||
12 | the Senate 90 or fewer days before the end
of the appointing | |||||||||||||||||||
13 | Governor's term ; or (2) by a board or other body having one or | |||||||||||||||||||
14 | more members appointed by the Governor, when the Governor does | |||||||||||||||||||
15 | not succeed himself or herself as Governor, and the effective | |||||||||||||||||||
16 | date of the appointment is 90 or fewer days before the end of | |||||||||||||||||||
17 | the appointing Governor's term. Item (2) does not apply to a | |||||||||||||||||||
18 | board or other body to which the Attorney General, Secretary of | |||||||||||||||||||
19 | State, Comptroller, or Treasurer also appoints one or more | |||||||||||||||||||
20 | members .

21 | "Succeeding Governor" means the Governor in office | |||||||||||||||||||
22 | immediately after a
Governor who appoints a late term | |||||||||||||||||||
23 | appointee.
