Bill Title: Amends the Illinois Governmental Ethics Act. Provides that a "late term appointee" also means a person who is appointed to an office by a board or other body having one or more members appointed by the Governor, when the Governor does not succeed himself or herself as Governor, and the effective date of the appointment is 90 or fewer days before the end of the appointing Governor's term. Provides that the provision added by the amendatory Act does not apply to a board or other body to which the Attorney General, Secretary of State, Comptroller, or Treasurer also appoints one or more members. Effective immediately.

SYNOPSIS AS INTRODUCED:
5 ILCS 420/3A-5

Amends the Illinois Governmental Ethics Act. Provides that a "late term appointee" also means a person who is appointed to an office by a board or other body having one or more members appointed by the Governor, when the Governor does not succeed himself or herself as Governor, and the effective date of the appointment is 90 or fewer days before the end of the appointing Governor's term. Provides that the provision added by the amendatory Act does not apply to a board or other body to which the Attorney General, Secretary of State, Comptroller, or Treasurer also appoints one or more members. Effective immediately.

1 AN ACT concerning government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Governmental Ethics Act is amended
5by changing Section 3A-5 as follows:
6 (5 ILCS 420/3A-5)
7 Sec. 3A-5. Definitions. As used in this Article:
8 "Late term appointee" means a person who is appointed to an
9office: (1) by a Governor who does not succeed himself or
10herself as Governor, whose appointment requires the advice and
11consent of the Senate, and whose appointment is confirmed by
12the Senate 90 or fewer days before the end of the appointing
13Governor's term; or (2) by a board or other body having one or
14more members appointed by the Governor, when the Governor does
15not succeed himself or herself as Governor, and the effective
16date of the appointment is 90 or fewer days before the end of
17the appointing Governor's term. Item (2) does not apply to a
18board or other body to which the Attorney General, Secretary of
19State, Comptroller, or Treasurer also appoints one or more
20members.
21 "Succeeding Governor" means the Governor in office
22immediately after a Governor who appoints a late term
23appointee.
