Bill Title: Amends the University of Illinois Hospital Act, the Hospital Licensing Act, the Managed Care Reform and Patient Rights Act, the Medical Practice Act of 1987, and the Illinois Public Aid Code. Provides that, notwithstanding any other provision of law, hospitals and physicians organized or licensed under the Acts and health plans and managed care organizations must provide medical facts regarding COVID-19 and vaccines that can be used to protect against COVID-19 to all patients under the care of the hospital, physician, health plan, or managed care organization. Makes conforming changes in the Illinois Insurance Code. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

4 | Section 5. The University of Illinois Hospital Act is | |||||||||||||||||||||||||||||
5 | amended by adding Section 8e as follows:

7 | Sec. 8e. COVID-19 and vaccine information. Notwithstanding | |||||||||||||||||||||||||||||

13 | adding Section 6.30 as follows:

companies that transact the kinds of insurance | ||||||

6 | Code shall comply
with Sections 15.1, 45, 45.1, 45.2, and 85, | ||||||
7 | subsection (d) of Section 30, and the definition of the term | ||||||
8 | "emergency medical
condition" in Section
10 of the Managed | ||||||
9 | Care Reform and Patient Rights Act.

12 | is amended by adding Section 15.1 as follows:

15 | Notwithstanding any other provision of law, a health care plan | ||||||
16 | must provide medical facts regarding COVID-19 and vaccines | ||||||
17 | that can be used to protect against COVID-19 to all patients | ||||||
18 | under the hospital's care.

19 | Section 25. The Medical Practice Act of 1987 is amended by | ||||||
20 | adding Section 3.6 as follows:

2 | Notwithstanding any other provision of law, a physician | ||||||
3 | licensed under this Act must provide medical facts regarding | ||||||
4 | COVID-19 and vaccines that can be used to protect against | ||||||
5 | COVID-19 to all patients under the physician's care.

6 | Section 30. The Illinois Public Aid Code is amended by | ||||||
7 | adding Section 5-30.18 as follows:

8 | (305 ILCS 5/5-30.18 new) | ||||||
9 | Sec. 5-30.18. COVID-19 and vaccine information. | ||||||
10 | (a) Notwithstanding any other provision of law, an MCO | ||||||
11 | must provide medical facts regarding COVID-19 and vaccines | ||||||
12 | that can be used to protect against COVID-19 to all patients | ||||||
13 | under the MCO's care. | ||||||
14 | (b) As used in this Section, "MCO" has the same meaning as | ||||||
15 | provided in Section 30.1.

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law.
