Bill Title: Creates the 5-day Budget Review Act. Prohibits a hearing or vote on any appropriation bill or revenue bill for at least 5 days after the bill is made publicly available. Provides that a vote on an amendment to an appropriation bill or a revenue bill is not in order unless that amendment is made publicly available at least 48 hours prior to the vote. Provides that these temporal limitations may be waived by an affirmative two-thirds vote of the full committee or house considering the legislation. Effective immediately.

New Act

1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the 5-day
5Budget Review Act.
6 Section 5. Definitions. As used in this Act:
7 "Amendment" means any proposed change to a bill.
8 "Appropriation bill" means any bill authorizing an
9appropriation of funds for State operating, capital, or
10transportation expenses.
11 "Publicly available" means available for viewing on the
12General Assembly's website and published in a bill report,
13committee report, or conference committee report.
14 "Revenue bill" means any bill that raises revenue for
15operating, capital, or transportation expenses.
16 "Striking amendment" means any amendment removing and
17replacing everything after the enacting clause of a bill.
18 Section 10. Hearing or votes prohibited for 5 days. A
19hearing or vote on any appropriation bill or revenue bill is
20prohibited for at least 5 days after the bill is made publicly
21available. This 5-day period excludes Saturdays, Sundays, and
22holidays unless the house considering the bill is in session

2 Section 15. Adoption of amendments and striking
3amendments.
4 (a) A vote on an amendment to an appropriation bill or a
5revenue bill, other than a striking amendment, is not in order
6unless that amendment is made publicly available at least 48
7hours prior to the vote. This 48-hour period excludes
8Saturdays, Sundays, and holidays unless the house considering
9the bill is in session on that day.
10 (b) A vote on a striking amendment to an appropriation
11bill or a revenue bill is not in order unless that amendment is
12made publicly available at least 48 hours prior to the vote.
13This 48-hour period excludes Saturdays, Sundays, and holidays
14unless the house considering the bill is in session on that
15day.
16 Section 20. Application to multiple stages of
17consideration. The time limitations in this Act apply each
18time a new version of an appropriation bill or a revenue bill
19is considered. This includes consideration of conference
20committee recommendations.
21 Section 25. Exceptions. The time limitation of this Act
22may be waived by an affirmative two-thirds vote of the full
23committee or house considering the legislation. For any such

1legislation, the following statement with respect to the
2legislation must be included in any bill report and on the
3General Assembly's website:
4 "The (insert the house or committee) has waived the
5 People's right for a detailed review of this legislation,
6 as required under the 5-day Budget Review Act.".
