1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Nursing Home Care Act is amended by adding | |||||||||||||||||||
5 | Section 2-218 as follows:

6 | (210 ILCS 45/2-218 new) | |||||||||||||||||||
7 | Sec. 2-218. Opioid treatment program. | |||||||||||||||||||
8 | (a) A long-term care facility that desires to provide an | |||||||||||||||||||
9 | opioid treatment program must first receive written approval | |||||||||||||||||||
10 | from the Department. The approval shall be granted only if it | |||||||||||||||||||
11 | can be shown that the program will not interfere in any way | |||||||||||||||||||
12 | with the residents in the other parts of the facility. | |||||||||||||||||||
13 | (b) The opioid treatment program must be in a completely | |||||||||||||||||||
14 | separate and distinct part of the long-term care facility and | |||||||||||||||||||
15 | must include all beds in that separate and distinct part. It | |||||||||||||||||||
16 | must be completely separated from the rest of the facility and | |||||||||||||||||||
17 | have separate entrances. | |||||||||||||||||||
18 | (c) Beds designated for opioid treatment shall not be used | |||||||||||||||||||
19 | for long-term care residents, nor shall beds designated for | |||||||||||||||||||
20 | long-term care residents be used for residents undergoing | |||||||||||||||||||
21 | treatment for opioids. | |||||||||||||||||||
22 | (d) The opioid treatment program staff shall not be | |||||||||||||||||||
23 | utilized in performing services in the long-term care area of |

1 | the facility, nor shall long-term care program staff be | ||||||
2 | utilized to provide any services in the opioid treatment | ||||||
3 | designated area. | ||||||
4 | (e) There may be joint use of laundry, food service, | ||||||
5 | housekeeping, and administrative services, provided written | ||||||
6 | approval is obtained from the Department. The approval shall be | ||||||
7 | granted only if it can be shown that the joint usage will not | ||||||
8 | interfere in any way with the residents in other parts of the | ||||||
9 | facility.
