Bill Title: Amends the School Code. Provides that, beginning on July 1, 2011, no scholarships may be awarded under provisions that permit members of the General Assembly to award scholarships to persons for attendance at a State sponsored university. Provides that a scholarship awarded before July 1, 2011 is valid until its stated term expires, but may not be renewed. Effective July 1, 2011.

1 | AN ACT concerning education.
| |||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||||||
4 | Section 5. The School Code is amended by changing Sections | |||||||||||||||||||||||
5 | 30-9, 30-10, and 30-11 as follows:

7 | Sec. 30-9.
General Assembly scholarship; conditions of | |||||||||||||||||||||||
8 | admission; award by
competitive examination.

9 | Each member of the General Assembly may nominate annually 2 | |||||||||||||||||||||||
10 | persons of
school age and otherwise eligible, from his | |||||||||||||||||||||||
11 | district; each shall
receive a
certificate of scholarship in | |||||||||||||||||||||||
12 | any State supported
university designated by the member. Any | |||||||||||||||||||||||
13 | member of the General Assembly in
making nominations under this | |||||||||||||||||||||||
14 | Section may designate that his nominee be
granted a 4 year | |||||||||||||||||||||||
15 | scholarship or may instead designate 2 or 4 nominees for
that | |||||||||||||||||||||||
16 | particular scholarship, each to receive a 2 year or a one year
| |||||||||||||||||||||||
17 | scholarship, respectively. The nominee, if a graduate of a | |||||||||||||||||||||||
18 | school
accredited by the University to which nominated, shall | |||||||||||||||||||||||
19 | be admitted to the
university on the same conditions as to | |||||||||||||||||||||||
20 | educational qualifications as are
other graduates of | |||||||||||||||||||||||
21 | accredited schools. If the nominee is not a graduate of
a | |||||||||||||||||||||||
22 | school accredited by the university to which nominated, he | |||||||||||||||||||||||
23 | must, before
being entitled to the benefits of the scholarship, |

1 | pass an examination
given by the superintendent of schools of | ||||||
2 | the county where he resides at
the time stated in Section 30-7 | ||||||
3 | for the competitive examination. The
president of each | ||||||
4 | university shall prescribe the rules governing the
examination | ||||||
5 | for scholarship to his university.
| ||||||
6 | A member of the General Assembly may award the scholarship | ||||||
7 | by
competitive examination conducted under like rules as | ||||||
8 | prescribed in Section
30-7 even though one or more of the | ||||||
9 | applicants are graduates of schools
accredited by the | ||||||
10 | university.
| ||||||
11 | A member of the General Assembly may delegate to the | ||||||
12 | Illinois Student
Assistance Commission the authority to | ||||||
13 | nominate persons for General Assembly
scholarships which that | ||||||
14 | member would otherwise be entitled to award, or may
direct the | ||||||
15 | Commission to evaluate and make recommendations to the member
| ||||||
16 | concerning candidates for such scholarships. In the event a | ||||||
17 | member
delegates his nominating authority or directs the | ||||||
18 | Commission to evaluate
and make recommendations concerning | ||||||
19 | candidates for General Assembly
scholarships, the member shall | ||||||
20 | inform the Commission in writing of the
criteria which he | ||||||
21 | wishes the Commission to apply in nominating or
recommending | ||||||
22 | candidates. Those criteria may include some or all of the
| ||||||
23 | criteria provided in Section 25 of the Higher Education Student
| ||||||
24 | Assistance Act. A delegation of authority under this paragraph | ||||||
25 | may be revoked
at any time by the member.

26 | Failure of a member of the General Assembly to make a |
| |||||||
| |||||||
1 | nomination in any
year shall not cause that scholarship to | ||||||
2 | lapse, but the member may make a
nomination for such | ||||||
3 | scholarship at any time thereafter before the
expiration of his | ||||||
4 | term, and the person so nominated shall be entitled to
the same | ||||||
5 | benefits as holders of other scholarships provided herein. Any
| ||||||
6 | such scholarship for which a member has made no nomination | ||||||
7 | prior to the
expiration of the term for which he was elected | ||||||
8 | shall lapse upon the
expiration of that term. | ||||||
9 | Beginning on July 1, 2011, no scholarships may be awarded | ||||||
10 | under this Section. However, a scholarship awarded under this | ||||||
11 | Section before July 1, 2011 is valid until its stated term | ||||||
12 | expires, but may not be renewed.

Filing nominations-Failure to accept or | ||||||
16 | pass-Second
nomination.
| ||||||
17 | Nominations, under Section 30-9, showing the name and | ||||||
18 | address of the
nominee, and the term of the scholarship, | ||||||
19 | whether 4 years, 2 years or
one year, must be filed with the | ||||||
20 | State Superintendent of Education not later
than the opening | ||||||
21 | day of the semester or term with which the scholarship is to
| ||||||
22 | become effective. The State
Superintendent of Education shall | ||||||
23 | forthwith notify the
president of the university of such | ||||||
24 | nomination.
| ||||||
25 | If the nominee fails to accept the nomination or, not being |
| |||||||
| |||||||
1 | a
graduate of a school accredited by the university, fails to | ||||||
2 | pass the
examination for admission, the president of the | ||||||
3 | university shall at once
notify the State Superintendent of | ||||||
4 | Education. Upon receiving such notification,
the State | ||||||
5 | Superintendent of Education shall notify the nominating
| ||||||
6 | member, who may name another person for the scholarship. The | ||||||
7 | second
nomination must be received by the State Superintendent | ||||||
8 | of Education not
later than the middle of the semester or term | ||||||
9 | with which the scholarship
was to have become effective under | ||||||
10 | the original nomination in order to
become effective as of the | ||||||
11 | opening date of such semester or term
otherwise it shall not | ||||||
12 | become effective until the beginning of the next
semester or | ||||||
13 | term following the making of the second nomination. Upon
| ||||||
14 | receiving such notification, the State Superintendent of | ||||||
15 | Education shall
notify the president of the university of such | ||||||
16 | second nomination.
If any person nominated after the effective | ||||||
17 | date of this amendatory Act
of 1973 to receive a General | ||||||
18 | Assembly scholarship changes his residence
to a location | ||||||
19 | outside of the district from which he was nominated, his
| ||||||
20 | nominating member may terminate that scholarship at the | ||||||
21 | conclusion of
the college year in which he is then enrolled. | ||||||
22 | For purposes of this
paragraph, a person changes his residence | ||||||
23 | if he registers to vote in a
location outside of the district | ||||||
24 | from which he was nominated, but does
not change his residence | ||||||
25 | merely by taking off-campus housing or living
in a | ||||||
26 | nonuniversity residence.

8 | nominations. | ||||||
9 | If any nominee under Section 30-9 or 30-10 discontinues his | ||||||
10 | course
of instruction or fails to use the scholarship, leaving | ||||||
11 | 1, 2, 3, or 4
years thereof unused, the member of the General | ||||||
12 | Assembly may, except as
otherwise provided in this Article, | ||||||
13 | nominate some other person eligible
under this Article from his | ||||||
14 | district who shall be entitled to the
scholarship for the | ||||||
15 | unexpired period thereof. Such appointment to an
unexpired | ||||||
16 | scholarship vacated before July 1, 1961, may be made only by
| ||||||
17 | the member of the General Assembly who made the original | ||||||
18 | appointment and
during the time he is such a member. If a | ||||||
19 | scholarship is vacated on or
after July 1, 1961, and the member | ||||||
20 | of the General Assembly who made the
original appointment has | ||||||
21 | ceased to be a member, some eligible person may
be nominated in | ||||||
22 | the following manner to fill the vacancy: If the
original | ||||||
23 | appointment was made by a Senator, such nomination shall be
| ||||||
24 | made by the Senator from the same district; if the original | ||||||
25 | appointment
was made by a Representative,
such nomination
shall |
| |||||||

1 | be made by the Representative
from the same district. Every | ||||||
2 | nomination to fill a vacancy must
be accompanied either by a | ||||||
3 | release of the original nominee or if he is
dead then an | ||||||
4 | affidavit to that effect by some competent person. The
failure | ||||||
5 | of a nominee to register at the university within 20 days after
| ||||||
6 | the opening of any semester or term shall be deemed a release | ||||||
7 | by him of
the nomination, unless he has been granted a leave of | ||||||
8 | absence in
accordance with Section 30-14 or unless his absence | ||||||
9 | is by reason of his
entry into the military service of the | ||||||
10 | United States. The university shall immediately upon the
| ||||||
11 | expiration of 20 days after the beginning of the semester or | ||||||
12 | term notify
the State Board of Education
as to the status of | ||||||
13 | each
scholarship, who shall forthwith notify the nominating | ||||||
14 | member of any
nominee's failure to register or, if the | ||||||
15 | nominating member has ceased to
be a member of the General | ||||||
16 | Assembly, shall notify the member or members
entitled to make | ||||||
17 | the nomination to fill the vacancy. All nominations to unused
| ||||||
18 | or unexpired scholarships shall be effective as of the opening | ||||||
19 | of the semester
or term of the university during which they are | ||||||
20 | made if they are filed with
the university during the first | ||||||
21 | half of the semester or term, otherwise
they shall not be | ||||||
22 | effective until the opening of the next following
semester or | ||||||
23 | term.
