SYNOPSIS AS INTRODUCED:
735 ILCS 5/2-2302 new

Amends the Code of Civil Procedure. Provides that a settlement agreement in an action for damages for personal injury based on childhood sexual abuse shall not include the following: (1) a confidentiality provision binding on the person abused; or (2) a non-disparagement provision binding on the person abused.

1 AN ACT concerning civil law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Code of Civil Procedure is amended by adding
5Section 2-2302 as follows:
6 (735 ILCS 5/2-2302 new)
7 Sec. 2-2302. Settlements in lawsuits involving minors.
8 (a) A settlement agreement in an action for damages for
9personal injury based on childhood sexual abuse shall not
10include the following:
11 (1) a confidentiality provision binding on the person
12 abused; or
13 (2) a non-disparagement provision binding on the
14 person abused.
15 (b) As used in this Section, "childhood sexual abuse" has
16the meaning provided in Section 13-202.2 of this Code.
