Bill Title: Amends the School Code. Provides that alternative learning opportunities programs may include high school completion programs that allow certain students eligible for remote learning to complete their education while incarcerated in a Department of Corrections facility. Provides that the Chicago Board of Education may offer a remote learning option to a student who is in the custody of the Department of Corrections if the student (i) is enrolled at Consuella B. York Alternative High School at the time the student is transferred to a Department of Corrections facility or had been enrolled in the school within the 6 months prior to being transferred to a Department of Corrections facility and (ii) is within 2 school years of completing all of the course requirements necessary for high school graduation. Allows the school district to continue to offer the option of remote learning to the student to complete any remaining course requirements necessary for high school graduation for up to one school year following the student's release from the custody of the Department of Corrections. Effective immediately.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by changing Section
513B-20.5 and by adding Section 34-18.78 as follows:
6 (105 ILCS 5/13B-20.5)
7 Sec. 13B-20.5. Eligible activities and services.
8Alternative learning opportunities programs may include,
9without limitation, evening high school, in-school tutoring
10and mentoring programs, in-school suspension programs, high
11school completion programs to assist high school dropouts in
12completing their education, high school completion programs to
13allow students eligible for remote learning under Section
1434-18.78 to complete their education while incarcerated in an
15institution or facility of the Department of Corrections,
16support services, parental involvement programs, and programs
17to develop, enhance, or extend the transition for students
18transferring back to the regular school program, an adult
19education program, or a post-secondary education program.

22 Sec. 34-18.78. Pilot program for remote learning for

1students in the custody of the Department of Corrections. The
2board may offer the option of remote learning to allow a
3student who is in the custody of the Department of Corrections
4to successfully complete the course requirements necessary to
5graduate from high school and receive a high school diploma.
6The school district may offer a remote learning option to a
7student if the student:
8 (1) is enrolled at Consuella B. York Alternative High
9 School at the time the student is transferred to a
10 Department of Corrections facility or institution or had
11 been enrolled at Consuella B. York Alternative High School
12 within the 6 months prior to being transferred to a
13 Department of Corrections facility or institution; and
14 (2) is within 2 school years of completing all of the
15 course requirements necessary to graduate from high school
16 and receive a high school diploma.
17 The Department of Corrections educators and security staff
18shall be involved in assisting and supervising students
19participating in the pilot program. The Department of
20Corrections shall negotiate with all bargaining units involved
21to ensure that the implementation of the pilot program is
22consistent with collective bargaining agreements.
23 The school district may continue to offer the option of
24remote learning to the student for up to one school year
25following the student's release from the custody of the
26Department of Corrections to allow the student to complete any

1remaining course requirements necessary to graduate from high
2school and receive a high school diploma.
3 The establishment of the pilot program described in this
4Section is contingent upon there being provided to the
5Department of Corrections sufficient appropriations to
6implement and administer the program.
7 Section 99. Effective date. This Act takes effect upon
8becoming law.
