Amends the Environmental Protection Act. Makes a technical change in a Section concerning the intent of the Title regarding the site remediation program.

1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended by
5changing Section 58 as follows:
6 (415 ILCS 5/58)
7 Sec. 58. Intent. It is the the intent of this Title:
8 (1) To establish a risk-based system of remediation
9 based on protection of human health and the environment
10 relative to present and future uses of the site.
11 (2) To assure that the land use for which remedial
12 action was undertaken will not be modified without
13 consideration of the adequacy of such remedial action for
14 the new land use.
15 (3) To provide incentives to the private sector to
16 undertake remedial action.
17 (4) To establish expeditious alternatives for the
18 review of site investigation and remedial activities,
19 including a privatized review process.
20 (5) To assure that the resources of the Hazardous Waste
21 Fund are used in a manner that is protective of human
22 health and the environment relative to present and future
23 uses of the site and surrounding area.

1 (6) To provide assistance to units of local government
2 for remediation of properties contaminated or potentially
3 contaminated by commercial, industrial, or other uses, to
4 provide loans for the redevelopment of brownfields, and to
5 establish and provide for the administration of the
6 Brownfields Redevelopment Fund.
