Bill Title: Amends the Wind Farm Division of the Illinois Municipal Code. Changes the name of the Division to the Alternative Energy and Storage Division. Allows a municipality to own and operate a photovoltaic generation farm, energy storage facility, or biomass-fired combined heat and power plant that directly or indirectly reduces the energy or other operating costs of the municipality. Allows a municipality to ask for the assistance of any State agency in obtaining financing options for such operations. Effective immediately.

AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Municipal Code is amended by
changing the heading of Division 15.3 of Article 11 and by
adding Sections 11-15.3-5, 11-15.3-10, and 11-15.3-15 as
follows:

Sec. 11-15.3-5. Photovoltaic farms. A municipality may own
and operate a photovoltaic generation farm, either
individually or jointly with another unit of local government,
school district, or community college district that is
authorized to own and operate a photovoltaic generation farm,
that directly or indirectly reduces the energy or other
operating costs of the municipality. The municipality may ask
for the assistance of any State agency, including, without
limitation, the Department of Commerce and Economic
Opportunity, the Illinois Power Agency, or the Environmental
Protection Agency, in obtaining financing options for a

Sec. 11-15.3-10. Energy storage facility. A municipality
may own and operate an energy storage facility, either
individually or jointly with another unit of local government,
school district, or community college district that is
authorized to own and operate an energy storage facility, that
directly or indirectly reduces the energy or other operating
costs of the municipality. The municipality may ask for the
assistance of any State agency, including, without limitation,
the Department of Commerce and Economic Opportunity, the
Illinois Power Agency, or the Environmental Protection Agency,
in obtaining financing options for an energy storage facility.

combined heat and power plant, either individually or jointly

directly or indirectly reduces the energy or other operating
costs of the municipality. The municipality may ask for the
assistance of any State agency, including, without limitation,
the Department of Commerce and Economic Opportunity, the

Section 99. Effective date. This Act takes effect upon
becoming law.
