| 1 | AN ACT concerning safety.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 5. The Environmental Protection Act is amended by | |||||||||||||||||||
| 5 | changing Section 39.4 as follows:
| |||||||||||||||||||
| 6 | (415 ILCS 5/39.4) (from Ch. 111 1/2, par. 1039.4)

| 7 | Sec. 39.4.
(a) Upon receipt of a joint application | |||||||||||||||||||
| 8 | transmitted from
the
the Department of Agriculture for an | |||||||||||||||||||
| 9 | agrichemical facility construction or
operation permit or a | |||||||||||||||||||
| 10 | lawncare containment permit, the Agency may provide a
written | |||||||||||||||||||
| 11 | endorsement of the permit to be issued by the Department for | |||||||||||||||||||
| 12 | such
agrichemical facility or lawncare wash water containment | |||||||||||||||||||
| 13 | area. The Agency's
endorsement may be provided at any time | |||||||||||||||||||
| 14 | prior to final action by the Department
regarding the subject | |||||||||||||||||||
| 15 | permit. | |||||||||||||||||||
| 16 | (b) For all purposes of this Act, an agrichemical facility | |||||||||||||||||||
| 17 | permit
or lawncare containment permit endorsed by the Agency | |||||||||||||||||||
| 18 | pursuant to this Section
shall be deemed to be a permit issued | |||||||||||||||||||
| 19 | by the Agency pursuant to subsection (b)
of Section 9 and | |||||||||||||||||||
| 20 | subsection (b) of Section 12 of this Act. An agrichemical
| |||||||||||||||||||
| 21 | facility or a lawncare wash water containment area remains | |||||||||||||||||||
| 22 | subject to all
applicable permit requirements under this Act | |||||||||||||||||||
| 23 | if the Department of
Agriculture's agrichemical facility | |||||||||||||||||||
| |||||||
| |||||||
| 1 | permit or lawncare containment permit has
not been endorsed | ||||||
| 2 | pursuant to subsection (a) of this Section.
| ||||||
| 3 | (c) An agrichemical facility permit or a lawncare | ||||||
| 4 | containment permit
endorsed by the Agency shall not be subject | ||||||
| 5 | to the annual fee provisions of
Section 9.6 of this Act.
