Bill Title: Creates the Chicago Board of Education District Act. Divides the City of Chicago into 10 districts and 20 subdistricts for the purposes of identifying persons who will serve on the Chicago Board of Education. Amends the School Code. Provides that, by December 14, 2024, the Mayor of the City of Chicago shall appoint a President of the Chicago Board of Education who shall serve a 2-year term. Provides that, for purposes of selection of members of the Chicago Board of Education, the City of Chicago shall be divided into 10 districts, and each of those 10 districts shall be subdivided into 2 subdistricts. Provides that, until January 15, 2027, each district shall be represented by one member who is elected at the 2024 general election to a 2-year term and one member who is appointed by the Mayor by no later than December 16, 2024 to a 2-year term. Requires each of those elected members to reside within the district that the member represents. Requires each of those appointed members to reside both within the district that the member represents and outside of the subdistrict within which the elected member of the district resides. Provides that, beginning January 15, 2027, each subdistrict shall be represented by one member who is elected at the 2026 general election. Specifies that, if a member is elected at the 2026 general election to fill the expired term of an appointed member, then the elected member shall serve a 2-year term. Specifies that, if a member is elected at the 2026 general election to fill the expired term of an elected member, then the member shall serve a 4-year term. Requires each of those elected members to reside within the subdistrict that the member represents. Provides that, if a member is elected at the 2026 general election to serve a 2-year term, then the member elected at the 2028 general election shall serve a 4-year term, and, if a member is elected at the 2026 general election to serve a 4-year term, then the member elected in that subdistrict at the 2030 general election shall serve a 2-year term. Provides that, beginning with the members elected at the 2032 general election, the members of each district shall serve two 4-year terms and one 2-year term for each 10-year period thereafter as determined by lot. Makes changes concerning: conflicts of interests of board members, eligibility of individuals to serve as board members, nominating petitions for board members, the creation of the Chicago Board of Education Black Student Achievement Advisory Board and other advisory bodies, and the creation and redistricting of subdistricts. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Illinois Local Library Act is amended by | ||||||
5 | adding Section 1-8 as follows:
| ||||||
6 | (75 ILCS 5/1-8 new) | ||||||
7 | Sec. 1-8. Book bans prohibited. The board of trustees or | ||||||
8 | staff of a public library established under this Act shall not | ||||||
9 | limit access to biographies, autobiographies, memoirs, or any | ||||||
10 | other books or materials in the library or prohibit the | ||||||
11 | purchase for the library's collection of biographies, | ||||||
12 | autobiographies, memoirs, or any other books or materials | ||||||
13 | based upon the depiction in those books or materials of | ||||||
14 | matters of race, ethnicity, sexual orientation, sexual and | ||||||
15 | reproductive health, gender identity, religion, human rights | ||||||
16 | activism, or any other subject. This Section does not restrict | ||||||
17 | the board of trustees or staff of a public library established | ||||||
18 | under this Act from imposing limitations on access to books or | ||||||
19 | materials in the library for public safety reasons or based | ||||||
20 | upon the age and developmental level of persons who will have | ||||||
21 | access to those books or materials.

22 | Section 10. The Illinois Library System Act is amended by |

1 | changing Section 3 as follows:
| ||||||

3 | Sec. 3.
The State Librarian and his or her staff shall | ||||||
4 | administer the provisions
of this Act and shall prescribe such | ||||||
5 | rules and regulations as are necessary
to carry the provisions | ||||||
6 | of this Act into effect.
| ||||||
7 | The rules and regulations established by the State | ||||||
8 | Librarian for the
administration of this Act shall be designed | ||||||
9 | to achieve the following
standards and objectives:
| ||||||
10 | ( A ) provide library service for every citizen in the state | ||||||
11 | by extending
library facilities to areas not now served ; .
| ||||||
12 | ( B ) provide library materials for student needs at every | ||||||
13 | educational
level ; .
| ||||||
14 | ( C ) provide adequate library materials to satisfy the | ||||||
15 | reference and
research needs of the people of this state ; .
| ||||||
16 | ( D ) provide an adequate staff of professionally trained | ||||||
17 | librarians for
the state ; .
| ||||||
18 | ( E ) provide an adequate stock of books and other materials | ||||||
19 | sufficient in
size and varied in kind and subject matter to | ||||||
20 | satisfy the library needs of
the people of this state ; .

21 | ( F ) provide adequate library outlets and facilities | ||||||
22 | convenient in time
and place to serve the people of this | ||||||
23 | state ; .
| ||||||
24 | ( G ) encourage existing and new libraries to develop | ||||||
25 | library systems
serving a sufficiently large population to |

| |||||||
1 | support adequate library service
at reasonable cost ; .
| ||||||
2 | ( H ) foster the economic and efficient utilization of | ||||||
3 | public funds ; .
| ||||||
4 | ( I ) promote the full utilization of local pride, | ||||||
5 | responsibility,
initiative and support of library service and | ||||||
6 | at the same time employ state
aid as a supplement to local | ||||||
7 | support ; and .
| ||||||
8 | (J) prohibit the library systems established under this | ||||||
9 | Act and their staff from limiting access to biographies, | ||||||
10 | autobiographies, memoirs, or any other books or materials and | ||||||
11 | prohibit the purchase of biographies, autobiographies, | ||||||
12 | memoirs, or any other books or materials based upon the | ||||||
13 | depiction in those books or materials of matters of race, | ||||||
14 | ethnicity, sexual orientation, gender identity, religion, | ||||||
15 | human rights activism, or any other subject. This paragraph | ||||||
16 | (J) does not restrict a library system or its staff from | ||||||
17 | imposing limitations on access to books or materials in the | ||||||
18 | library system for public safety reasons or based upon the age | ||||||
19 | and developmental level of persons who will have access to | ||||||
20 | those books or materials. | ||||||
21 | The Advisory Committee of the Illinois State Library shall | ||||||
22 | confer with,
advise and make recommendations to the State | ||||||
23 | Librarian regarding any matter
under this Act and particularly | ||||||
24 | with reference to the formation of library
systems.

19 | Section 20. The Village Library Act is amended by adding | ||||||
20 | Section 6 as follows:

22 | Sec. 6. Book bans prohibited. The board of trustees or | ||||||
23 | staff of a village library established under this Act shall |

7 | health, gender identity, religion, human rights activism, or | ||||||

10 | imposing limitations on access to books or materials in the | ||||||
11 | village library for public safety reasons or based upon the | ||||||

14 | Section 25. The School Code is amended by by adding | ||||||
15 | Sections 10-20.85 and 34-18.82 as follows:

18 | district nor its staff shall limit access to biographies, | ||||||

22 | or any other books or materials based upon the depiction in | ||||||
