Bill Title: Amends the Eminent Domain Act. Provides that quick-take powers may be used for a period of one year after the effective date of the amendatory Act by the Village of Deer Park for the acquisition of certain described property for the purpose of a permanent Village utility easement for the transmission of potable water. Repeals the new provisions 3 years after the effective date. Effective immediately.

2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:

4 | Section 5. The Eminent Domain Act is amended by adding | ||||||
5 | Section 25-5-130 as follows:

6 | (735 ILCS 30/25-5-130 new) | ||||||
7 | Sec. 25-5-130. Quick-take; Village of Deer Park; 20820 N. | ||||||
8 | Rand Road. | ||||||
9 | (a) Quick-take proceedings under Article 20 may be used | ||||||
10 | for a period of one year after the effective date of this | ||||||
11 | amendatory Act of the 103rd General Assembly by the Village of | ||||||
12 | Deer Park for the acquisition of the following described | ||||||
13 | property for the purpose of a permanent Village utility | ||||||
14 | easement for the transmission of potable water:

15 | Part of 14-34-100-012, 20820 N. Rand Road | ||||||
16 | The Northerly 10 feet of the Property being a strip of land 10 | ||||||
17 | feet wide adjoining and parallel with the Southwesterly | ||||||
18 | right-of-way line of Rand Road (U.S. Route 12), said | ||||||
19 | Southwesterly right-of-way line being 50 feet Southwesterly of | ||||||
20 | and parallel with the centerline of Rand Road as per Plat of | ||||||
21 | Highway recorded December 2, 1983 as Document No. 2254251. | ||||||
22 | The "Property" is legally described as: |

1 | That part of the West Half of the North West Quarter of Section | ||||||
2 | 34, Township 43 North, Range 10, East of the 3rd Principal | ||||||
3 | Meridian described as follows: Beginning on the West line of | ||||||
4 | said Northwest Quarter at the Northwest corner of a tract of | ||||||
5 | land conveyed to Fritz Fisher by Warranty Deed dated August | ||||||
6 | 10, 1868 and recorded April 2, 1869 in Book 46 of Deeds Page | ||||||
7 | 552 (said point being 19.55 chains North of the Southwest | ||||||
8 | corner of said Quarter Section); thence North on said West | ||||||
9 | line 8.59 chains, more or less, to the center of Chicago Road | ||||||
10 | (so called); thence South 62 Degrees East in the center of said | ||||||
11 | Road, 11.30 chains; thence South 3.40 chains to the North line | ||||||
12 | of said Fisher's land; thence West on said North line to the | ||||||
13 | place of beginning (excepting therefrom that party lying | ||||||
14 | Westerly of the following described line: Beginning at the | ||||||
15 | Northeasterly corner of Creamery Lot as described in deed | ||||||
16 | recorded as Document 27470; thence Southwesterly along the | ||||||
17 | Southeasterly line of said Lot to the Southeasterly corner of | ||||||
18 | said Lot; thence South to a point in the North line of said | ||||||
19 | Fritz Fisher land, said point being 308.73 feet East of the | ||||||
20 | Northwest corner of said Fisher's land), and also excepting | ||||||
21 | therefrom that part lying Northeasterly of and adjoining the | ||||||
22 | Southwesterly right of way of Rand Road (U.S. 12), all in Lake | ||||||
23 | County, Illinois. | ||||||
24 | (b) This Section is repealed 3 years after the effective | ||||||
25 | date of this amendatory Act of the 103rd General Assembly.

26 | Section 99. Effective date. This Act takes effect upon |
