1 | AN ACT concerning education.
| ||||||
2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The School Code is amended by adding Sections | ||||||
5 | 2-3.157 and 34-18.49 as follows:
| ||||||
6 | (105 ILCS 5/2-3.157 new) | ||||||
7 | Sec. 2-3.157. City of Chicago School District 299 reports. | ||||||
8 | (a) The State Board of Education shall prepare a report on | ||||||
9 | the practices and trends in the operations of City of Chicago | ||||||
10 | School District 299 with respect to the impact of charter | ||||||
11 | school enrollment on the operation of the school district. The | ||||||
12 | State Board of Education shall gather data regarding student | ||||||
13 | enrollment and placement policies, disciplinary procedures, | ||||||
14 | programs for special education, English Language Learners | ||||||
15 | (ELL), and any other relevant student needs for each public | ||||||
16 | school in the district, including charter schools. The report | ||||||
17 | shall specifically identify any policies that give schools | ||||||
18 | latitude to discourage attendance of students or that would | ||||||
19 | create barriers for any students to attend. In addition, the | ||||||
20 | State Board of Education shall gather data on mobility, | ||||||
21 | attendance rates, graduation rates, and incoming and outgoing | ||||||
22 | transfers at each grade level for each public school in the | ||||||
23 | district, including charter schools. The report shall identify |

1 | the extent to which transfers from charter schools to other | ||||||
2 | schools occur before or after any deadlines related to funding. | ||||||
3 | The report shall identify the extent to which charter schools | ||||||
4 | accept transfers into the school at each grade level, as | ||||||
5 | compared to transfers out. The report shall compare charter | ||||||
6 | school enrollment by race, disability, income, and ELL status | ||||||
7 | to other charter and traditional public schools in the | ||||||
8 | district. The report shall compare the instructional programs, | ||||||
9 | methods, and instructional materials of each public school in | ||||||
10 | the district, including charter schools. | ||||||
11 | The district shall comply with all requests for information | ||||||
12 | made by the State Board of Education necessary for the State | ||||||
13 | Board of Education to prepare this report. | ||||||
14 | The State Board of Education shall file copies of this | ||||||
15 | report as provided in Section 3.1 of the General Assembly | ||||||
16 | Organization Act. | ||||||
17 | (b) The State Board of Education shall prepare a report on | ||||||
18 | the impact of school actions, such as school closures and | ||||||
19 | school turnarounds, on the practices and trends in the | ||||||
20 | operation of City of Chicago School District 299. The report | ||||||
21 | shall include all of the following: | ||||||
22 | (1) A community analysis that includes current and | ||||||
23 | projected demographics, land usage, transportation plans, | ||||||
24 | residential housing and commercial development, private | ||||||
25 | school plans for water and sewage expansion or | ||||||
26 | redevelopment, and institutions of higher education. |

1 | (2) A description of the district's guiding | ||||||
2 | educational principles and standards. | ||||||
3 | (3) A description of the types of instructional | ||||||
4 | programs or services delivered at each school. | ||||||
5 | (4) The enrollment capacity of each school and its rate | ||||||
6 | of utilization. | ||||||
7 | (5) A report on the assessment of individual building | ||||||
8 | and site conditions. | ||||||
9 | (6) A data table with historical and projected | ||||||
10 | enrollment data by school and by grade. | ||||||
11 | (7) An analysis of facility needs and requirements of | ||||||
12 | the district. | ||||||
13 | (8) Identification of potential sources of funding for | ||||||
14 | the implementation of the district's Educational Facility | ||||||
15 | Master Plan. | ||||||
16 | The report shall also include identification of all | ||||||
17 | external firms and agencies contracted to aid the district in | ||||||
18 | performing school actions and transitions. The firms and | ||||||
19 | agencies shall disclose financial interests, fees paid by the | ||||||
20 | district, and any and all relationships it holds with any | ||||||
21 | member of the school board or city council. | ||||||
22 | The district shall comply with all requests for information | ||||||
23 | made by the State Board of Education necessary for the State | ||||||
24 | Board of Education to prepare this report. | ||||||
25 | The State Board of Education shall file copies of this | ||||||
26 | report as provided in Section 3.1 of the General Assembly |

1 | Organization Act. | ||||||
2 | (c) The State Board of Education shall prepare a report on | ||||||
3 | the impact of standardized testing on the operations and | ||||||
4 | practices of City of Chicago School District 299. The report | ||||||
5 | shall include the amount of time educators prepare for tests, | ||||||
6 | administer tests, and analyze results. The report shall also | ||||||
7 | include the amount of money spent on procuring standardized | ||||||
8 | tests. The report shall include the number of tests given to | ||||||
9 | students and the frequency of tests at each grade level and at | ||||||
10 | each school in the district. The report shall include financial | ||||||
11 | disclosures by the company or firm that owns the tests and | ||||||
12 | preparation materials that include any prior relationships | ||||||
13 | with the district or agents of the district. The report shall | ||||||
14 | compare the frequency of tests given to students in schools | ||||||
15 | that have charters approved by the district and other district | ||||||
16 | schools. | ||||||
17 | The report shall be completed and made available to the | ||||||
18 | public each year on or before July 31. If the district does not | ||||||
19 | make available all information requested by the State Board of | ||||||
20 | Education necessary for the State Board of Education to prepare | ||||||
21 | this report, the State Board of Education, in an administrative | ||||||
22 | proceeding, shall impose a civil penalty on the district equal | ||||||
23 | to $2,900 for every day the information is unavailable after | ||||||
24 | the July 31 report date. The Attorney General may bring an | ||||||
25 | action in circuit court to enforce the collection of any | ||||||
26 | monetary penalty imposed. |

1 | (d) The State Board of Education may adopt any rules | ||||||
2 | necessary to carry out its responsibilities under this Section. | ||||||
3 | (e) The State Board of Education may enter into contracts | ||||||
4 | to fulfill the requirements of this Section. | ||||||
5 | (f) City of Chicago School District 299 is responsible for | ||||||
6 | all costs associated with the reports required in this Section.
