1 | AN ACT concerning local government.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Illinois Municipal Code is amended by | |||||||||||||||||||
5 | changing Section 8-2-9.1 as follows:

7 | Sec. 8-2-9.1. Budget officer. Every municipality with with | |||||||||||||||||||
8 | a population of
less than 500,000
(except special charter | |||||||||||||||||||
9 | municipalities having a population in excess of
50,000) that | |||||||||||||||||||
10 | has adopted this Section 8-2-9.1 and Sections
8-2-9.2
through | |||||||||||||||||||
11 | 8-2-9.10 by a two-thirds majority vote of those members of the
| |||||||||||||||||||
12 | corporate authorities then holding office shall have a budget | |||||||||||||||||||
13 | officer who
shall be designated by the mayor or president, with | |||||||||||||||||||
14 | the approval of the
corporate authorities. In municipalities | |||||||||||||||||||
15 | operating
under the
commission form of government, the | |||||||||||||||||||
16 | commissioner of accounts and
finances shall designate the | |||||||||||||||||||
17 | budget officer,
with the approval of the council or board of | |||||||||||||||||||
18 | trustees, as the case may
be. In municipalities with a | |||||||||||||||||||
19 | managerial form of government, the
municipal
manager shall | |||||||||||||||||||
20 | designate the budget officer. The budget officer shall
take an | |||||||||||||||||||
21 | oath and post a bond as provided in
Section 3.1-10-25. The | |||||||||||||||||||
22 | budget officer may hold another municipal
office,
either | |||||||||||||||||||
23 | elected or appointed, and may receive compensation for both |
| |||||||
| |||||||
1 | offices.
Article 10 of this Code shall not apply to an | ||||||
2 | individual serving as the
budget officer. The budget officer | ||||||
3 | shall serve at the pleasure of
the
mayor or municipal manager, | ||||||
4 | as the case may be.
