Bill Title: Amends the Prevailing Wage Act. Provides that the Act does not apply to wages paid to all laborers, workers, and mechanics employed by or on behalf of public body for work performed on a public works project with a total cost of $20,000 or less if the public body notifies the Department of Labor of each project for which the waiver is used within 60 days before commencing the project. Provides that the Department shall make available a form with which public bodies may make this notification. Provides that the Department shall submit an annual report detailing the number of projects for which the waiver was used in the preceding year, the total number of employees engaged in those projects, the total cost of those projects without using prevailing wage standards, the total cost of those projects using prevailing wage standards, and any other information the Department deems appropriate. Effective immediately.

1 | AN ACT concerning employment.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Prevailing Wage Act is amended by adding | |||||||||||||||||||||
5 | Sections 1a and 11c as follows:

6 | (820 ILCS 130/1a new) | |||||||||||||||||||||
7 | Sec. 1a. Waiver. This Act does not apply to wages paid to | |||||||||||||||||||||
8 | all laborers, workers, and mechanics employed by or on behalf | |||||||||||||||||||||
9 | of a public body for work performed on a public works project | |||||||||||||||||||||
10 | with a total cost of $20,000 or less if no additional work is | |||||||||||||||||||||
11 | performed in connection with the project within 24 months | |||||||||||||||||||||
12 | after the completion of the project. A public body using this | |||||||||||||||||||||
13 | waiver shall notify the Department of Labor of each project | |||||||||||||||||||||
14 | for which the waiver is used within 60 days before commencing | |||||||||||||||||||||
15 | the project. The Department of Labor shall make available a | |||||||||||||||||||||
16 | form with which public bodies may make such notification, | |||||||||||||||||||||
17 | including a description of the project, the number of | |||||||||||||||||||||
18 | employees engaged in the project, the total cost of the | |||||||||||||||||||||
19 | project without using prevailing wage standards, the total | |||||||||||||||||||||
20 | cost of the project using prevailing wage standards, and any | |||||||||||||||||||||
21 | other reasonable information the Department of Labor deems | |||||||||||||||||||||
22 | appropriate. The waiver available under this Section is | |||||||||||||||||||||
23 | available only to the extent permitted under federal law and |

3 | Sec. 11c. Reports. Beginning in 2024, the Department of | ||||||
4 | Labor shall submit to the Governor and General Assembly an | ||||||
5 | annual report no later than January 31 of each year detailing | ||||||
6 | the number of public works projects for which the waiver | ||||||
7 | described in Section 1a was used in the preceding year, the | ||||||
8 | total cost of those projects without using prevailing wage | ||||||
9 | standards, the total cost of those projects using prevailing | ||||||
10 | wage standards, and any other information the Department of | ||||||
11 | Labor deems appropriate.
