1 | AN ACT concerning animals.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Animal Control Act is amended by changing | ||||||
5 | Sections 2.11c, 3.5, and 9 as follows:

7 | Sec. 2.11c. Intact animal. "Intact animal" means an animal | ||||||
8 | that has not been sterilized spayed or neutered .

11 | Sec. 3.5. County animal population fund use limitation. | ||||||
12 | Funds placed in the county animal population control fund may | ||||||
13 | only be used to (1) spay, neuter, vaccinate , or sterilize | ||||||
14 | adopted dogs or cats; (2) sterilize spay, neuter, or vaccinate | ||||||
15 | dogs or cats owned by low income county residents who are | ||||||
16 | eligible for the Food Stamp Program or Social Security | ||||||
17 | Disability Benefits Program; or (3) sterilize spay, neuter, | ||||||
18 | and vaccinate feral cats in programs recognized by the county | ||||||
19 | or a municipality. This Section does not apply to a county with | ||||||
20 | 3,000,000 or more inhabitants.

2 | Sec. 9. Any dog found running at large contrary to | ||||||
3 | provisions of this Act
may
be apprehended and impounded. For | ||||||
4 | this purpose, the Administrator shall
utilize any existing or | ||||||
5 | available animal control facility or licensed animal shelter. | ||||||
6 | The dog's owner shall pay a $25 public safety fine to be | ||||||
7 | deposited into the county animal control fund or the county | ||||||
8 | pet population control fund. Funds transferred to or retained | ||||||
9 | by a municipality before the effective date of this amendatory | ||||||
10 | Act of the 100th General Assembly under this paragraph shall | ||||||
11 | continue to be transferred to and be retained by that | ||||||
12 | municipality. A dog found running at large contrary to the | ||||||
13 | provisions of this Act a second or subsequent time must be | ||||||
14 | sterilized spayed or neutered within 30 days after being | ||||||
15 | reclaimed unless already sterilized spayed or neutered ; | ||||||
16 | failure to comply shall result in impoundment.

17 | A dog that is actively engaged in a legal hunting | ||||||
18 | activity, including training, is not considered to be running | ||||||
19 | at large if the dog is on land that is open to hunting or on | ||||||
20 | land on which the person has obtained permission to hunt or to | ||||||
21 | train a dog. A dog that is in a dog-friendly area or dog park | ||||||
22 | is not considered to be running at large if the dog is | ||||||
23 | monitored or supervised by a person.
