Bill Title: Amends the Counties Code and the Illinois Municipal Code. Provides that a county board or the corporate authorities of a municipality shall not adopt a code or ordinance that (i) prohibits a person or entity from installing or equipping fire sprinklers in specified residences or (ii) requires a person or entity to install or equip fire sprinklers in specified residences. Provides that a county board or the corporate authorities of a municipality shall not impose any fine, penalty, or other requirement on any person or entity for installing or equipping or not installing or equipping fire sprinklers in specified residences. Effective immediately.

AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Counties Code is amended by adding Section
5-1131 as follows:

Sec. 5-1131. Fire sprinklers. A county board shall not
adopt a code or ordinance that prohibits a person or entity
from installing or equipping fire sprinklers in a single family
detached residence or any residential building that contains
not more than 2 dwelling units. A county board shall not adopt
a code or ordinance that requires a person or entity to install
or equip fire sprinklers in a single family detached residence
or any residential building that contains not more than 2
dwelling units. A county board shall not impose any fine,
penalty, or other requirement on any person or entity for
installing or equipping or not installing or equipping fire
sprinklers in such residence. This Section does not apply to
any code or ordinance that requires fire sprinklers in a
residence that was adopted before December 31, 2009.
Section 10. The Illinois Municipal Code is amended by
adding Section 1-2-13 as follows:

a municipality shall not adopt a code or ordinance that
prohibits a person or entity from installing or equipping fire
sprinklers in a single family detached residence or any
residential building that contains not more than 2 dwelling

adopt a code or ordinance that requires a person or entity to
install or equip fire sprinklers in a single family detached
residence or any residential building that contains not more
than 2 dwelling units. The corporate authorities of a
municipality shall not impose any fine, penalty, or other
requirement on any person or entity for installing or equipping
or not installing or equipping fire sprinklers in such
residence. This Section does not apply to any code or ordinance
that requires fire sprinklers in a residence that was adopted
before December 31, 2009.
Section 99. Effective date. This Act takes effect upon
becoming law.
