Bill Title: Amends the Illinois Health Facilities Planning Act. Provides that the annual report of capital expenditures submitted to the Health Facilities and Services Review Board by certain health care facilities shall include (i) whether the health care facility administered an affirmative action program for minority-owned, women-owned, veteran-owned, and small business enterprises and (ii) the percentage of the annual capital expenditure that was actually spent on minority-owned, women-owned, veteran-owned, and small business enterprises, respectively. Provides that the Board shall not consider that information when reviewing an application for a permit or exemption under the Act. Effective immediately.

AN ACT concerning State government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Health Facilities Planning Act is
amended by changing Section 5.3 as follows:

Sec. 5.3. Annual report of capital expenditures. In
addition to the State Board's authority to require reports, the
State Board shall require each health care facility to submit
an annual report of all capital expenditures in excess of
$200,000 (which shall be annually adjusted to reflect the
increase in construction costs due to inflation) made by the
health care facility during the most recent year. This annual
report shall consist of a brief description of the capital
expenditure, the amount and method of financing the capital
expenditure, the certificate of need project number if the
project was reviewed, and the total amount of capital
expenditures obligated for the year. This annual report shall
also include (i) whether the health care facility administered
an affirmative action program for minority-owned, women-owned,
veteran-owned, and small business enterprises and (ii) the
percentage of the annual capital expenditure that was actually

spent on minority-owned, women-owned, veteran-owned, and small
business enterprises, respectively; however, the Board shall
not consider the information provided in items (i) and (ii)
when reviewing an application for a permit or exemption under
this Act. Data collected from health care facilities pursuant
to this Section shall not duplicate or overlap other data
collected by the Department and must be collected as part of
the Department's Annual Questionnaires or supplements for
health care facilities that report these data.

Section 99. Effective date. This Act takes effect upon
becoming law.
