Bill Title: Amends the Illinois Highway Code. Provides that motor fuel tax funds allotted to municipalities may be used for the treatment or removal of trees infected with Dutch elm disease or ash trees infected with the emerald ash borer from any parcel of public or private property within the municipality.

AMENDMENT TO SENATE BILL 2658
AMENDMENT NO. ______. Amend Senate Bill 2658 on page 1, by
replacing lines 12 through 18 with the following:
"Sec. 7-202.23. Treatment or removal of elm trees infected
with Dutch elm disease or ash trees infected with the emerald
ash borer (Agrilus planipennis Fairmaire) from any parcel of
public property within the municipality. Municipalities may
use motor fuel tax funds under the general maintenance program
for the treatment or removal of ash trees if the following
criteria are met:
(a) the municipality is located in the emerald ash borer
quarantine zone published by the Illinois Department of
Agriculture;
(b) the ash trees are located on the public right-of-way or
are a potential hazard to vehicle travel;
(c) the ash trees to be removed are shown in a detailed
inventory; and

(d) motor fuel tax funds are not used to plant replacement
trees.".
