AMENDMENT TO SENATE BILL 2658
2 AMENDMENT NO. ______. Amend Senate Bill 2658 on page 1, by
3replacing lines 12 through 18 with the following:
4 "Sec. 7-202.23. Treatment or removal of elm trees infected
5with Dutch elm disease or ash trees infected with the emerald
6ash borer (Agrilus planipennis Fairmaire) from any parcel of
7public property within the municipality. Municipalities may
8use motor fuel tax funds under the general maintenance program
9for the treatment or removal of ash trees if the following
10criteria are met:
11 (a) the municipality is located in the emerald ash borer
12quarantine zone published by the Illinois Department of
13Agriculture;
14 (b) the ash trees are located on the public right-of-way or
15are a potential hazard to vehicle travel;
16 (c) the ash trees to be removed are shown in a detailed
17inventory; and

1 (d) motor fuel tax funds are not used to plant replacement
2trees.".
