1 | AN ACT concerning public employee benefits.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Pension Code is amended by changing | ||||||
5 | Section 7-155 as follows:
| ||||||
6 | (40 ILCS 5/7-155) (from Ch. 108 1/2, par. 7-155)
| ||||||
7 | Sec. 7-155. Surviving spouse annuities-commencement. | ||||||
8 | (a) A surviving spouse annuity shall begin on the 1st day | ||||||
9 | of the month
next following the month in which the | ||||||
10 | participating employee, or the
employee annuitant or such | ||||||
11 | person entitled to a retirement annuity died,
upon a written | ||||||
12 | application therefor, provided:

13 | 1. Any such annuity payments payable for periods | ||||||
14 | beginning Such date is not more than one year prior to the | ||||||
15 | date the
application was received by the Board shall not | ||||||
16 | include interest based on late payment ; and
| ||||||
17 | 2. The amount of surviving spouse annuity before the | ||||||
18 | application of
paragraph 3 of Section 7-158, is at least $5 | ||||||
19 | per month, beginning on
such date.

20 | (b) A person receiving a surviving spouse annuity whose | ||||||
21 | annuity was granted but limited to one year prior to the | ||||||
22 | application date under the former provisions of this Section | ||||||
23 | may reapply for annuity payments for the period denied due to |

1 | the one-year limitation. Such annuity payments shall not | ||||||
2 | include interest based on late payment. | ||||||
3 | (c) The changes to this Section made by this amendatory Act | ||||||
4 | of the 99th General Assembly apply without regard to whether | ||||||
5 | the deceased spouse was in service on or after the effective | ||||||
6 | date of this amendatory Act. | ||||||
