1 AN ACT concerning wildlife.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Wildlife Code is amended by changing Section
5 2.2 as follows:
6 (520 ILCS 5/2.2) (from Ch. 61, par. 2.2)
7 Sec. 2.2. This Act shall apply only to the the wild birds
8 and parts of wild birds (their nests and eggs), and wild
9 mammals and parts of wild mammals, which shall include their
10 green hides, in the State of Illinois, or which may be brought
11 into the State, that are hereby defined as follows:
12 All birds, both game and non-game (except the House
13 Sparrow, Passer domesticus; European Starling, Sturnus
14 vulgaris; and Rock Dove or Domestic Pigeon, Columba livia).
15 GAME BIRDS-Ruffed grouse, Bonasa umbellus; Sharp-tailed
16 grouse, Pediocetes phasianellus; Bobwhite quail, Colinus
17 virginianus; Hungarian Partridge, Perdix perdix; Chukar
18 Partridge, Alectoris graeca; Ring-necked Pheasant, Phasianus
19 colchicus; Greater Prairie Chicken, Tympanuchus cupido; Wild
20 Turkey, Meleagris gallopavo. MIGRATORY GAME BIRDS-Waterfowl
21 including brant, wild ducks, geese and swans, Anatidae; rails,
22 gallinules and coots, Rallidae; snipe, Gallinago gallinago;
23 woodcock, Scolopax minor; pigeons, including doves and wild

1 pigeons (except domestic pigeons), Columbidae; and crows,
2 Corvidae. RESIDENT AND MIGRATORY NON-GAME BIRDS-Loons,
3 Gaviidae; grebes, Podicipedidae; pelicans, Pelecanidae;
4 cormorants, Phalacrocoracidae; herons, bitterns and egrets,
5 Ardeidae; ibises and spoonbills, Threskiornithidae; storks,

12 cinereoagenteus; Coyote, Canis latrans; Bobcat, Lynx rufus.
13 OTHER MAMMALS-Flying squirrel, Glaucomys volans; Red squirrel,
14 Tamiasciurus hudsonicus; Eastern Woodrat, Neotoma floridana;
15 Golden Mouse, Ochrotomys nuttalli; Rice Rat, Oryzomys
16 palustris; Bats, Vespertilionidae.
17 It shall be unlawful for any person at any time to take,
18 possess, sell, or offer for sale, any of these wild birds (dead
19 or alive) and parts of wild birds (including their nests and
20 eggs), wild mammals (dead or alive) and parts of wild mammals,
21 including their green hides contrary to the provisions of this
22 Act. However, nothing in this Act shall prohibit bona-fide
23 public or state scientific, educational or zoological
24 institutions from receiving, holding and displaying wildlife
25 specimens that were salvaged or legally obtained.
26 It shall be unlawful for any person to bring into the State

1 of Illinois for the purpose of holding, releasing, propagating
2 or selling any other living wild animal not covered by this Act
3 without first obtaining a permit from the Director. The permit
4 shall be granted only upon satisfactory proof that the specific
5 animals intended to be imported are free of communicable
6 disease at the time of importation, will not become a nuisance,
7 and will not cause damage to any existing wild or domestic
8 species. Application for this permit shall be filed with the
9 Director not less than 30 days in advance of the proposed date
10 of importation. The Director may incorporate in the permit any
11 restrictions as he may deem appropriate. These provisions shall
12 not apply to any animal imported into this State for the
13 purpose of being confined and exhibited in any zoo or other
14 public display of animals nor to any other animals or groups of
15 animals that the Department of Natural Resources may exempt by
16 administrative rule.
17 It shall be unlawful for any person to take any other
18 living wild animal not covered by this Act without the
19 permission of the landowner or tenant.
