| 1 | AMENDMENT TO SENATE BILL 3265
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 3265 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Illinois Municipal Code is amended by | ||||||
| 5 | adding Section 11-80-24 as follows:
| ||||||
| 6 | (65 ILCS 5/11-80-24 new) | ||||||
| 7 | Sec. 11-80-24. Bicycle sharing systems. No bicycle sharing | ||||||
| 8 | system may operate a docking station in any area in any | ||||||
| 9 | municipality if (1) the area is adjacent to the primary | ||||||
| 10 | entrance of any elementary or secondary school building, (2) | ||||||
| 11 | the area is within 125 feet of any entrance to any elementary | ||||||
| 12 | or secondary school building, and (3) the area may be used as a | ||||||
| 13 | fire lane by emergency vehicles. | ||||||
| 14 | For purposes of this Section: | ||||||
| 15 | "Bicycle sharing system" means a fleet of bicycles that are | ||||||
| 16 | locked into a network of docking stations that may be rented | ||||||

| |||||||
| 1 | from and returned to any station in the system. | ||||||
| 2 | "Docking station" includes, but is not limited to, a | ||||||
| 3 | touch-screen kiosk, station map, and a docking system that | ||||||
| 4 | releases bicycles using a member key or code. | ||||||
| 5 | "Fire lane" shall have the same meaning provided under | ||||||
| 6 | subsection (h) of Section 11-209 of the Illinois Vehicle Code. | ||||||
| 7 | A home rule municipality may not regulate bicycle sharing | ||||||
| 8 | systems in a manner less restrictive than requirements of this | ||||||
| 9 | Section. This Section is a limitation under subsection (i) of | ||||||
| 10 | Section 6 of Article VII of the Illinois Constitution on the | ||||||
| 11 | concurrent exercise by home rule units of powers and functions | ||||||
| 12 | exercised by the State.".
