Bill Title: Amends the Toll Highway Act. Increases the number of directors of the Illinois State Toll Highway Authority appointed by the Governor from 9 to 11. Provides that, of the 11 directors of the Authority appointed by the Governor, at least one shall be from Cook County, at least one shall be from Lake County, at least one shall be from DuPage County, at least one shall be from Will County, at least one shall be from Winnebago, Boone, or McHenry County, and at least one shall be from Kane, DeKalb, Ogle, or Lee County. Provides that no more than 6 (rather than 5) directors shall be from the same political party. Provides that, within 30 days of the effective date of the amendatory Act, the Governor shall appoint one director from Lake County and one director from Winnebago, Boone, or McHenry County. Effective immediately.

SYNOPSIS AS INTRODUCED:
605 ILCS 10/3 from Ch. 121, par. 100-3

Amends the Toll Highway Act. Increases the number of directors of the Illinois State Toll Highway Authority appointed by the Governor from 9 to 11. 1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Toll Highway Act is amended by changing
5Section 3 as follows:
6 (605 ILCS 10/3) (from Ch. 121, par. 100-3)
7 Sec. 3. There is hereby created an Authority to be known as
8The Illinois State Toll Highway Authority, which is hereby
9constituted an instrumentality and an administrative agency of
10the State of Illinois. The said Authority shall consist of 13
1111 directors; the Governor and the Secretary of the Department
12of Transportation, ex officio, and 11 9 directors appointed by
13the Governor with the advice and consent of the Senate, from
14the State at large, which said directors and their successors
15are hereby authorized to carry out the provisions of this Act,
16and to exercise the powers herein conferred. Of the 11 9
17directors appointed by the Governor, at least one director
18shall be from Cook County, at least one director shall be from
19Lake County, at least one director shall be from DuPage County,
20at least one director shall be from Will County, at least one
21director shall be from Winnebago, Boone, or McHenry County, at
22least one director shall be from Kane, DeKalb, Ogle, or Lee
23County, and no more than 6 5 shall be members of the same

1political party. Within 30 days after the effective date of
2this amendatory Act of the 101st General Assembly, the Governor
3shall appoint one director from Lake County and one director
4from Winnebago, Boone, or McHenry County.
5 Notwithstanding any provision of law to the contrary, the
6term of office of each director of the Authority serving on the
7effective date of this amendatory Act of the 100th General
8Assembly, other than the Governor and the Secretary of the
9Department of Transportation, is abolished and a vacancy in
10each office is created on the effective date of this amendatory
11Act of the 100th General Assembly. The Governor shall appoint
12directors to the Authority for the vacancies created under this
13amendatory Act of the 100th General Assembly by February 28,
142019. Directors whose terms are abolished under this amendatory
15Act of the 100th General Assembly shall be eligible for
16reappointment.
17 Vacancies shall be filled for the unexpired term in the
18same manner as original appointments. All appointments shall be
19in writing and filed with the Secretary of State as a public
20record. It is the intention of this section that the Governor's
21appointments shall be made with due consideration to the
22location of proposed toll highway routes so that maximum
23geographic representation from the areas served by said toll
24highway routes may be accomplished insofar as practicable. The
25said Authority shall have the power to contract and be
26contracted with, to acquire, hold and convey personal and real

1property or any interest therein including rights of way,
2franchises and easements; to have and use a common seal, and to
3alter the same at will; to make and establish resolutions,
4by-laws, rules, rates and regulations, and to alter or repeal
5the same as the Authority shall deem necessary and expedient
6for the construction, operation, relocation, regulation and
7maintenance of a system of toll highways within and through the
8State of Illinois.
9 Appointment of the additional directors provided for by
10this amendatory Act of 1980 shall be made within 30 days after
11the effective date of this amendatory Act of 1980.

13 Section 99. Effective date. This Act takes effect upon
14becoming law.
