Bill Title: Amends the School Code. Provides that, upon knowledge of an incident of sexual assault committed on school grounds or at a school-sponsored activity or event by a student against a teacher, a teacher against a student, or a student against another student, a school district shall report the incident to the State Board of Education; defines "sexual assault". Provides that the State Board shall post on its Internet website for each school year the total number of reported incidents statewide and in each school district. Provides that the State Board shall also report the data annually to the General Assembly no later than September 1 of each year.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by adding Sections
52-3.173, 10-20.67, and 34-18.60 as follows:
6 (105 ILCS 5/2-3.173 new)
7 Sec. 2-3.173. Sexual assault data. The State Board of
8Education shall post on its Internet website for each school
9year the total number of incidents reported under Sections
1010-20.67 and 34-18.60 of this Code statewide and in each school
11district. The State Board shall also report the data annually
12to the General Assembly no later than September 1 of each year.
13The report to the General Assembly shall be filed with the
14Clerk of the House of Representatives and the Secretary of the
15Senate in electronic form only, in the manner that the Clerk
16and the Secretary shall direct.

19 (a) In this Section, "sexual assault" means any act of
20nonconsensual sexual conduct or sexual penetration, as defined
21under Section 11-0.1 of the Criminal Code of 2012, including,
22but not limited to, acts prohibited under Sections 11-1.20

9 Sec. 34-18.60. Attacks on students; sexual assault.
10 (a) In this Section, "sexual assault" means any act of
11nonconsensual sexual conduct or sexual penetration, as defined
12under Section 11-0.1 of the Criminal Code of 2012, including,
13but not limited to, acts prohibited under Sections 11-1.20
14through 11-1.60 of the Criminal Code of 2012.
