Synopsis: Immunity when granting access to cemetery. Provides
immunity from civil liability to landowners who grant a decedent's
family members and descendants access to cemeteries that are located
on the landowners' properties and subject to property tax assessment as
cemetery lands. Provides immunity from civil liability to persons who
guide family members or descendants to those cemeteries.
Effective: July 1, 2012.

A BILL FOR AN ACT to amend the Indiana Code concerning civil
procedure.
(1) A family member or descendant who passes through the landowner's property and enters the cemetery is considered to have assumed the risk of any injury occurring to the individual's health, life, or property during the time the
individual is present on the landowner's property.
(2) The landowner is immune from civil liability for any
injury occurring to the health, life, or property of a family
member or descendant during the time the family member or
descendant is present on the land on which the cemetery is
located.
(3) A person guiding a family member or descendant to the
cemetery is immune from civil liability for any injury
occurring to the health, life, or property of the family member
or descendant during the time the guide and the family
member or descendant are present on the land on which the
cemetery is located.
