Synopsis: School instructional time. Provides that a school
corporation may, instead of conducting 180 instructional days per
school year, conduct at least the equivalent (in minutes) of 183
instructional days per year. Provides that if a school corporation elects
to provide instructional days per year in minutes, instructional time
includes the equivalent of three student instructional days (in minutes)
each school year to be used for professional development activities.
Provides that the number of minutes of instructional time that a school
corporation shall conduct per school year is 54,900 minutes for grades
1 through 6 and 65,880 minutes for grades 7 through 12. Makes
conforming amendments.

A BILL FOR AN ACT to amend the Indiana Code concerning
education.
(1) time during which students are participating in:
under the direction of a teacher, including a reasonable amount of passing time between classes;
(2) for a school corporation that conducts instructional time under section 3(a)(2) of this chapter, time used for professional development activities that does not exceed:
(A) for grades 1 through 6, nine hundred (900) minutes;
(B) for grades 7 through 12, one thousand eighty (1,080) minutes; and
(C) for a school flex program under section 2.2 of this chapter, five hundred forty (540) minutes;
in a single school year.
(b) Instructional time does not include lunch or recess.
(1) for a school corporation that conducts instructional time under section 3(a)(1) of this chapter, at least five (5) hours of instructional time; or
(2) for a school corporation that conducts instructional time under section 3(a)(2) of this chapter, at least three hundred (300) minutes of instructional time.
(b) Except as provided in subsection
(1) for a school corporation that conducts instructional time under section 3(a)(1) of this chapter, at least six (6) hours of instructional time; or
(2) for a school corporation that conducts instructional time under section 3(a)(2) of this chapter, at least three hundred sixty (360) minutes of instructional time.
(1) for a school corporation that conducts instructional time under section 3(a)(1) of this chapter, three (3) hours of instructional time; or
(2) for a school corporation that conducts instructional time under section 3(a)(2) of this chapter, at least one hundred eighty (180) minutes of instructional time.
(1) at least one hundred eighty (180) student instructional days; or
(2) at least:
(A) fifty-four thousand nine hundred (54,900) minutes of instructional time, for grades 1 through 6; and
(B) sixty-five thousand eight hundred eighty (65,880)
minutes of instructional time, for grades 7 through 12.
(b) Not later than June 15 of each school year, the superintendent of
each school corporation shall certify to the department the number
amount of student instructional days time conducted during that
school year.
(1) This subdivision applies to a school corporation that conducts instructional time under section 3(a)(1) of this chapter.
STEP ONE: Determine the remainder of:
(i) the amount of the total tuition support allocated to the school corporation for the particular school year; minus
(ii) that part of the total tuition support allocated to the school corporation for that school year with respect to student instructional days one hundred seventy-six (176) through one hundred eighty (180).
STEP TWO: Subtract the number of student instructional days that the school corporation conducted from one hundred eighty (180).
STEP THREE: Determine the lesser of five (5) or the remainder determined under STEP TWO.
STEP FOUR: Divide the amount subtracted under STEP ONE(B) by five (5).
STEP FIVE: Multiply the quotient determined under STEP FOUR by the number determined under STEP THREE.
STEP SIX: Subtract the number determined under STEP THREE from the remainder determined under STEP TWO.
STEP SEVEN: Divide the remainder determined under STEP ONE by one hundred seventy-five (175).
STEP EIGHT: Multiply the quotient determined under STEP SEVEN by the remainder determined under STEP SIX.
STEP NINE: Add the product determined under STEP FIVE to the product determined under STEP EIGHT.
(2) This subdivision applies to a school corporation that conducts instructional time under section 3(a)(2) of this chapter.
(A) This clause applies to grades 1 through 6.
STEP ONE: Divide the amount of the total tuition support allocated to the school corporation for the particular school year by the current ADM (as defined in IC 20-43-1-10) for the school corporation.
STEP TWO: Multiply the STEP ONE amount by the number of students included in the school corporation's current ADM who are in grades 1 through 6.
STEP THREE: Divide the STEP TWO amount by fifty-four thousand nine hundred (54,900).
STEP FOUR: Subtract the amount of instructional time, expressed in minutes, that the school corporation conducted from fifty-four thousand nine hundred (54,900).
STEP FIVE: Multiply the quotient determined under STEP THREE by the number determined under STEP FOUR.
(B) This clause applies to grades 7 through 12.
STEP ONE: Divide the amount of the total tuition support allocated to the school corporation for the particular school year by the current ADM (as defined in IC 20-43-1-10) for the school corporation.
STEP TWO: Multiply the STEP ONE amount by the number of students included in the school corporation's current ADM who are in grades 7 through 12.
STEP THREE: Divide the STEP TWO amount by sixty-five thousand eight hundred eighty (65,880).
STEP FOUR: Subtract the amount of instructional time, expressed in minutes, that the school corporation conducted from sixty-five thousand eight hundred eighty (65,880).
STEP FIVE: Multiply the quotient determined under STEP THREE by the number determined under STEP FOUR.
(1) the school corporation applies to the department for a waiver of the penalty imposed under section 4 of this chapter for a specific
time; and
(2) each of the particular number amount of student instructional
days time requested to be waived under this section was canceled
due to extraordinary circumstances.
(1) is enrolled in a public school and a nonpublic school;
(2) has legal settlement in a school corporation; and
(3) receives instructional services from the school corporation.
(b) For purposes of this section, full-time equivalency is calculated as follows:
STEP ONE: Determine the result of
(A) for a school corporation that conducts instructional time under IC 20-30-2-3(a)(1), one hundred eighty (180) divided by
(B) for a school corporation that conducts instructional time under IC 20-30-2-3(a)(2), one hundred eighty-three (183) divided by one hundred eighty-three (183).
STEP TWO: Determine the result of:
(A) the pupil's public school instructional time (as defined in IC 20-30-2-1); divided by
(B) the actual public school regular instructional day (as defined in IC 20-30-2-2).
STEP THREE: Determine the result of:
(A) the STEP ONE result; multiplied by
(B) the STEP TWO result.
STEP FOUR: Determine the lesser of one (1) or the result of:
(A) the STEP THREE result; multiplied by
(B) one and five hundredths (1.05).
