Synopsis: Water liens. Provides that rates and charges of a water utility constitute a lien against property served by the water utility. Provides that the method for attachment and enforcement of water utility liens is the same as the existing method for wastewater utility liens.

    A BILL FOR AN ACT to amend the Indiana Code concerning utilities.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 8-1.5-3-8.4; (13)IN1447.1.1. -->     SECTION 1. IC 8-1.5-3-8.4 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 8.4. The rates and charges made and established by a municipally owned water utility for water service provided to a property constitute a lien against the property. The lien is superior to and takes precedence over all other liens except a lien for taxes. The lien attaches and shall be enforced in the manner liens attach and are enforced under IC 36-9-23. The enforcement of a lien under this section is in addition to any penalties provided under section 4 of this chapter, IC 36-9-23-6, or IC 36-9-25-11.5.
