Synopsis: School year; calendar flexibility. Prohibits public schools and accredited nonpublic schools from beginning student instructional days for the school year before the Tuesday after the first Monday in September (Labor Day) and from ending after June 10 of the following year, beginning with the 2012-2013 school year. Makes an exception for year-round schools. Makes the change effective for collective bargaining agreements and contracts negotiated after June 30, 2012. Requires the education roundtable to study and make recommendations to the general assembly concerning school calendar flexibility for high performing schools.

Effective: July 1, 2010.

SENATE BILL No. 150



    A BILL FOR AN ACT to amend the Indiana Code concerning education.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 20-30-2-9; (10)IN0150.1.1. -->     SECTION 1. IC 20-30-2-9 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2010]: Sec. 9. (a) This section does not apply to a year-round school that conducts student instructional days (other than during summer school) during a school term of twelve (12) consecutive months.
    (b) Beginning with the 2012-2013 school year, the student instructional days that make up a school year may not:
        (1) begin before the Tuesday after Labor Day, the first Monday in September; and
        (2) end after June 10 of the following year.

SOURCE: ; (10)IN0150.1.2. -->     SECTION 2. [EFFECTIVE JULY 1, 2010] (a) IC 20-30-2-9, as added by this act, applies only to a collective bargaining agreement between a school employer (as defined in IC 20-29-2-15) and an exclusive representative that is entered into after June 30, 2012.
    (b) IC 20-30-2-9, as added by this act, applies only to a contract entered into or renewed by a school after June 30, 2012.
    (c) This SECTION expires June 30, 2013.

SOURCE: ; (10)IN0150.1.3. -->     SECTION 3. [EFFECTIVE JULY 1, 2010] (a) As used in this SECTION, "roundtable" refers to the education roundtable established by IC 20-19-4-2.
    (b) The roundtable shall study and make recommendations to the general assembly concerning school performance and calendar flexibility, including:
        (1) appropriate performance measures;
        (2) levels of performance at which a school may receive the flexibility to change the length of a school year, week, or day; and
        (3) other related topics, including appropriate funding requirements.
    (c) The roundtable shall make the recommendations required under subsection (b) before December 1, 2010. The recommendations must be in an electronic format under IC 5-14-6.
    (d) This SECTION expires December 31, 2010.
