Synopsis: Blood sample and chemical test fee. Provides that in a court action in which a defendant is found to have committed a crime, violated a statute defining an infraction, or violated an ordinance of a municipal corporation, if a: (1) blood sample is obtained from the defendant at the expense of a political subdivision; or (2) blood sample obtained from the defendant has a chemical test performed on it to determine the presence of alcohol or a controlled substance in the defendant's blood at the expense of a political subdivision; the clerk of the court is required to collect from the defendant a blood sample and chemical test fee of $35. Requires: (1) the clerk to forward the fee to the fiscal officer of the political subdivision that paid to obtain the blood sample or test the blood sample, or both; and (2) the fiscal officer to deposit the fee into the general fund of the political subdivision.

SENATE BILL No. 586



    A BILL FOR AN ACT to amend the Indiana Code concerning courts and court officers.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 33-37-6.5; (11)IN0586.1.1. -->     SECTION 1. IC 33-37-6.5 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]:
     Chapter 6.5. Blood Sample and Chemical Test Fee
    Sec. 1. This chapter applies to each action in which a defendant is found to have:
        (1) committed a crime;
        (2) violated a statute defining an infraction; or
        (3) violated an ordinance of a municipal corporation.
    Sec. 2. If:
        (1) a blood sample is obtained from the defendant at the expense of a political subdivision; or
        (2) a blood sample obtained from the defendant has a chemical test performed on the blood sample:
            (A) to determine the presence of alcohol or a controlled substance in the defendant's blood; and
            (B) at the expense of a political subdivision;
the clerk shall collect from the defendant a blood sample and chemical test fee of thirty-five dollars ($35).
    Sec. 3. The clerk shall forward a fee collected under section 2 of this chapter to the fiscal officer of the political subdivision that paid to obtain the blood sample or test the blood sample, or both.
    Sec. 4. The fiscal officer of the political subdivision shall deposit a fee forwarded to the fiscal officer under section 3 of this chapter into the general fund of the political subdivision.
