An Act relative to protecting the rights of custodial, maintenance
and other nonteaching employees of school districts.
Be
it enacted by the Senate and House of Representatives in General Court
assembled, and by the authority of the same, as follows:
SECTION 1. Section 59B of chapter 71 is hereby amended by adding the following words at the end of the first paragraph: “as used in this section, the words, “other personnel” shall not include custodial maintenance, clerical, and any other similar positions not providing direct educational services to students. In the case of such positions, the hiring, promotion and firing of employees shall be completed in accordance with the provisions of any collective bargaining agreement covering such employees, or, in the absence of a collective bargaining agreement, by the school committee.”
