An Act clarifying a definition in workman's compensation
proceedings.
Be
it enacted by the Senate and House of Representatives in General Court
assembled, and by the authority of the same, as follows:
SECTION 1. Section 1 of Chapter 152 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended in line 161 by inserting after the definition of the term “Reviewing board” the following new definition:- “Proceeding” includes conciliations, conferences, hearings and presentations to appellate courts. “Proceedings” shall also include any action or actions by a party, including attorneys and medical experts acting on behalf of a party, at any time during and after the filing of the claim up to the time that the case is resolved and the employees is not receiving any benefits pursuant to chapter 152 and there is no action pending before the Department or any appellate court.”
