HOUSE BILL No. 4076

 

January 22, 2009, Introduced by Rep. Valentine and referred to the Committee on Judiciary.

 

     A bill to amend 1943 PA 240, entitled

 

"State employees' retirement act,"

 

by amending section 3 (MCL 38.3).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 3. (1) The retirement board shall consist of 9 11

 

members, as follows:

 

     (a) The insurance commissioner, the attorney general, the

 

state treasurer, the deputy legislative auditor general, and the

 

state personnel director.

 

     (b) Two Three employee members of the retirement system, who

 

shall be appointed by the governor. Not more than 1 employee member

 

of the retirement board shall be from any 1 department, bureau, or

 

agency of state government. The term of office of the employee

 

members shall be 3 4 years. No employee member shall be employed in

 


a department represented by a member identified in subdivision (a).

 

     (c) The 2 3 retirant members shall be retirants of the

 

retirement system, who shall be appointed by the governor. The term

 

of office of the retirant members shall be 3 4 years.

 

     (2) After the effective date of this amendatory act, the seat

 

of the first employee member to retire at the expiration of the

 

member's present term or the member's retirement from active

 

service, whichever shall be first, shall be filled by the

 

appointment of a second retirant member.
