HOUSE BILL No. 4346

     A bill to amend 1949 PA 300, entitled

 

"Michigan vehicle code,"

 

(MCL 257.1 to 257.923) by adding section 811nn.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 811nn. (1) The secretary of state shall develop under

 

section 811e and issue under section 811f a fund-raising plate

 

recognizing the public libraries of this state. The secretary of

 

state, with input from the libraries of this state, shall design

 

the fund-raising plates authorized in this section.

 

     (2) The Michigan library fund is created within the state

 

treasury. The state treasurer may receive money or other assets

 

from any source for deposit into the fund. The state treasurer

 

shall direct the investment of the fund. The state treasurer shall

 

credit to the fund interest and earnings from fund investments.

 

Money in the fund at the close of the fiscal year shall remain in


the fund and shall not lapse to the general fund. The state

 

treasurer shall be the administrator of the fund for auditing

 

purposes.

 

     (3) The secretary of state shall transfer the donation money

 

from the sale of fund-raising plates recognizing the public

 

libraries of this state to the state treasurer, who shall credit

 

the donation money to the fund established under subsection (2).

 

     (4) No later than July 14 of each year, the department of

 

education shall transmit to the state treasurer a statement of the

 

qualified public libraries that are entitled to receive a

 

distribution under subsection (5) during that year and the service

 

area population for each qualified public library.

 

     (5) The state treasurer shall disburse money in the fund

 

established under subsection (2) no later than August 1 of each

 

year to the public libraries of this state. The state treasurer

 

shall disburse the money per capita based on the service area

 

population of each qualified public library. Money disbursed under

 

this subsection shall be applied exclusively to the support of

 

public libraries in this state and shall not be used for any other

 

purpose.

 

     (6) As used in this section:

 

     (a) "Qualified public library" means a legally established

 

public library that qualifies for state aid under the state aid to

 

public libraries act, 1977 PA 89, MCL 397.551 to 397.576.

 

     (b) "Service area population" includes the legal service area

 

and contracted-for service areas of a public library.

 

     Enacting section 1. This amendatory act takes effect 90 days


after the date it is enacted into law.
