A bill to amend 1979 PA 152, entitled
"State license fee act,"
by amending sections 13, 17, 21, 25, 27, 29, 31, 37, 38, and 43
(MCL 338.2213, 338.2217, 338.2221, 338.2225, 338.2227, 338.2229,
338.2231, 338.2237, 338.2238, and 338.2243), sections 13, 17, 21,
25, 27, 29, 31, 37, and 38 as amended by 2012 PA 308 and section
43 as amended by 2013 PA 78.

8 (3) The real estate education fund is created in the state
9 treasury. All of the following apply to the real estate education
10 fund:
11 (a) Fifteen dollars of each license fee received by the
12 department under subsection (1)(b) during that 3-year license
13 cycle shall be forwarded to the state treasurer for deposit into
14 the real estate education fund.
15 (b) The department shall use the money in the real estate
16 education fund only for the operation of departmental programs
17 related to education required of all licensees or applicants for
18 licensure under article 25 of the occupational code, MCL 339.2501
19 to 339.2518.
20 (c) The state treasurer shall direct the investment of the
21 fund and shall credit to the fund interest and earnings from fund
22 investments.
23 (d) Money in the fund at the close of the fiscal year shall
24 remain in the fund and shall not lapse to the general fund.
25 (e) The department is the administrator of the fund for
26 auditing purposes.
1 (4) The real estate enforcement fund is created in the state
2 treasury. All of the following apply to the real estate
3 enforcement fund:
4 (a) Fifteen dollars of each license fee received by the
5 department under subsection (1)(b) during that 3-year license
6 cycle shall be forwarded to the state treasurer for deposit into
7 the real estate enforcement fund.
8 (b) The department in conjunction with the attorney general
9 shall use the money in the real estate enforcement fund only for
10 the investigation and enforcement of actions regarding unlicensed
11 activity and real estate fraud.
12 (c) The state treasurer shall direct the investment of the
13 fund and shall credit to the fund interest and earnings from fund
14 investments.
15 (d) Money in the fund at the close of the fiscal year shall
16 remain in the fund and shall not lapse to the general fund.
17 (e) The department is the administrator of the fund for
18 auditing purposes.
19 Sec. 38. (1) Fees for an individual licensed or seeking
20 licensure as a state licensed real estate appraiser, a certified
21 general real estate appraiser, a certified residential real
22 estate appraiser, or a limited real estate appraiser under
23 article 26 of the occupational code, MCL 339.2601 to 339.2637,
24 are as follows:

6 (2) The license fee includes a fee imposed by the federal
7 government under 12 USC 3338 for certified general real estate
8 appraisers, certified residential real estate appraisers, and
9 state licensed real estate appraisers. The amount of the fee
10 described in this subsection shall not exceed $50.00 per
11 licensee, and the department shall collect and pay the fee to the
12 federal government under section 2637 of the occupational code,
13 MCL 339.2637.
14 (3) The real estate appraiser education fund is created in
15 the state treasury. All of the following apply to the real estate
16 appraiser education fund:
17 (a) Ten dollars of each fee received under subsection (1)(c)
18 shall be forwarded to the state treasurer for deposit into the
19 real estate appraiser education fund.
20 (b) The department shall use the money in the real estate
21 appraiser education fund only for the operation of departmental
22 programs related to the education required of all licensees or
23 applicants for licensure under article 26 of the occupational
24 code, MCL 339.2601 to 339.2637.
25 (c) The state treasurer shall direct the investment of the
