Sec. 201. Pursuant to section 30 of article IX of the state constitution of 1963, total state spending from state resources under part 1 for the fiscal year ending September 30, 2022 is $89,170,900.00 and state spending from state resources to be paid to local units of government for the fiscal year ending September 30, 2022 is $2,622,900.00. Sec. 202. The appropriations authorized under this part and part 1 are subject to the management and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.

Sec. 203. As used in this part and part 1:

(a) "Department" means the department of natural resources.

(b) "Director" means the director of the department.

(c) "FTE" means full-time equated.

(d) "IDG" means interdepartmental grant.

Sec. 204. The departments and agencies receiving appropriations in part 1 shall use the internet to fulfill the reporting requirements of this part. This requirement shall include transmission of reports via email to the recipients identified for each reporting requirement and it shall include placement of reports on an internet site.

Sec. 205. To the extent permissible under section 261 of the management and budget act, 1984 PA 431:

(a) Funds appropriated in part 1 shall not be used for the purchase of foreign goods or services, or both, if competitively priced and of comparable quality American goods or services, or both, are available.

(b) Preference shall be given to goods or services, or both, manufactured or provided by Michigan businesses if they are competitively priced and of comparable quality.

(c) In addition, preference should be given to goods or services, or both, that are manufactured or provided by Michigan businesses owned and operated by veterans, if they are competitively priced and of comparable quality.

Sec. 206. The department shall not take disciplinary action against an employee of the department or departmental agency in the state classified civil service because the employee communicates with a member of the senate or house or his or her staff, unless the communication is prohibited by law and the department or agency taking disciplinary action is exercising its authority as provided by law.

Sec. 207. Consistent with section 217 of the management and budget act, 1984 PA 431, the departments and agencies receiving appropriations in part 1 shall prepare a report on out-of-state travel expenses not later than January 1 of each year. The travel report shall be a listing of all travel by classified and unclassified employees outside this state in the immediately preceding fiscal year that was funded in whole or in part with funds appropriated in part 1. The report shall be submitted to the senate and house appropriations committees, the senate and house fiscal agencies, and the state budget director. The report shall include the following information:

(a) The dates of each travel occurrence.

(b) The transportation and related costs of each travel occurrence, including the proportion funded with state general fund/general purpose revenues, the proportion funded with state restricted revenues, the proportion funded with federal revenues, and the proportion funded with other revenues.

Sec. 208. Funds appropriated in part 1 shall not be used by

the department to hire a person to provide legal services that are the responsibility of the attorney general. This prohibition does not apply to legal services for bonding activities and for those outside services that the attorney general authorizes.

Sec. 209. Not later than November 30, the state budget office shall prepare and transmit a report that provides for estimates of the total general fund/general purpose appropriation lapses at the close of the prior fiscal year. This report shall summarize the projected year-end general fund/general purpose appropriation lapses by major departmental program or program areas. The report shall be transmitted to the chairs of the senate and house appropriations committees, and the senate and house fiscal agencies.

Sec. 210. In addition to the funds appropriated in part 1, there is appropriated an amount not to exceed $5,000,000.00 for state restricted contingency authorization. These funds are not available for expenditure until they have been transferred to another line item in part 1 under section 393(2) of the management and budget act, 1984 PA 431, MCL 18.1393.

Sec. 211. From the funds appropriated in part 1, the department shall provide to the department of technology, management, and budget information sufficient to maintain a searchable website accessible by the public at no cost that includes, but is not limited to, all of the following for each department or agency:

(a) Fiscal year-to-date expenditures by category.

(b) Fiscal year-to-date expenditures by appropriation unit.

(c) Fiscal year-to-date payments to a selected vendor, including the vendor name, payment date, payment amount, and

payment description.

(d) The number of active department employees by job classification.

(e) Job specifications and wage rates.

Sec. 212. Within 14 days after the release of the executive budget recommendation, the department shall provide to the state budget office information sufficient to provide the senate and house appropriations chairs, the senate and house appropriations subcommittees chairs, and the senate and house fiscal agencies with an annual report on estimated state restricted fund balances, state restricted fund projected revenues, and state restricted fund expenditures for the fiscal years ending September 30, 2021 and September 30, 2022.

Sec. 213. The department shall maintain, on a publicly accessible website, a department scorecard that identifies, tracks, and regularly updates key metrics that are used to monitor and improve the department's performance.

Sec. 214. Total authorized appropriations from all sources under part 1 for legacy costs for the fiscal year ending September 30, 2022 are estimated at $43,528,600.00. From this amount, total agency appropriations for pension-related legacy costs are estimated at $24,387,100.00. Total agency appropriations for retiree health care legacy costs are estimated at $19,141,500.00.

Sec. 215. The director shall take all reasonable steps to ensure businesses in deprived and depressed communities compete for and perform contracts to provide services or supplies, or both. The director shall strongly encourage firms with which the department contracts to subcontract with certified businesses in depressed and deprived communities for services, supplies, or both.

Sec. 216. (1) On a quarterly basis, the department shall report to the senate and house appropriations committees, the senate and house appropriations subcommittees on the department budget, and the senate and house fiscal agencies the following information:

(a) The number of FTEs in pay status by type of staff and civil service classification.

(b) A comparison by line item of the number of FTEs authorized from funds appropriated in part 1 to the actual number of FTEs employed by the department at the end of the reporting period.

(2) By April 1 of the current fiscal year and semiannually thereafter, the department shall report to the senate and house appropriations committees, the senate and house appropriations subcommittees on the department budget, and the senate and house fiscal agencies the following information:

(a) Number of employees that were engaged in remote work in 2021.

(b) Number of employees authorized to work remotely and the actual number of those working remotely in the current reporting period.

(c) Estimated net cost savings achieved by remote work.

(d) Reduced use of office space associated with remote work.

Sec. 217. Appropriations in part 1 shall, to the extent possible, not be expended by the department until all existing work project authorization available for the same purpose is exhausted.

Sec. 218. If the state administrative board, acting under section 3 of 1921 PA 2, MCL 17.3, transfers funds from an amount appropriated under part 1, the legislature may, by a concurrent resolution adopted by a majority of the members elected to and

serving in each house, intertransfer funds within part 1 for the particular department, board, commission, officer, or institution.

Sec. 219. The departments and agencies receiving appropriations in part 1 shall receive and retain copies of all reports funded from appropriations in part 1. Federal and state guidelines for short-term and long-term retention of records shall be followed. The department may electronically retain copies of reports unless otherwise required by federal and state guidelines.

Sec. 220. The department shall report no later than April 1 on each specific policy change made to implement a public act affecting the department that took effect during the prior calendar year to the senate and house appropriations committees, the senate and house subcommittees on natural resources, the joint committee on administrative rules, and the senate and house fiscal agencies.

Sec. 221. Appropriations of state restricted game and fish protection funds are being made, other than in part 1 or this part, in the following amounts to the following departments and agencies:

Sec. 222. Pursuant to section 43703(3) of the natural resources and environmental protection act, 1994 PA 451, MCL 324.43703, there is appropriated from the game and fish protection trust fund to the game and fish protection account of the Michigan conservation and recreation legacy fund, $6,000,000.00 for the fiscal year ending September 30, 2022.

Sec. 223. The department may contract with or provide grants

to local units of government, institutions of higher education, or nonprofit organizations to support activities authorized by appropriations in part 1. As used in this section, contracts and grants include, but are not limited to, contracts and grants for research, wildlife and fisheries management, forest management, invasive species monitoring and control, and natural resource-related programs.

Sec. 224. (1) From the funds appropriated in part 1, the department shall do all of the following:

(a) Report to the house and senate appropriations committees, the house and senate fiscal agencies, the house and senate policy offices, and the state budget office any amounts of severance pay for a department director, deputy director, or other high-ranking department official not later than 14 days after a severance agreement with the director or official is signed. The name of the director or official and the amount of severance pay must be included in the report required by this subdivision.

(b) Maintain an internet site that posts any severance pay in excess of 6 weeks of wages, regardless of the position held by the former department employee receiving severance pay.

(c) By February 1, report to the house and senate appropriations subcommittees on the department budget, the house and senate fiscal agencies, the house and senate policy offices, and the state budget office on the total amount of severance pay remitted to former department employees during the fiscal year ending September 30, 2021 and the total number of former department employees that were remitted severance pay during the fiscal year ending September 30, 2021.

(2) As used in this section, "severance pay" means

compensation that is both payable or paid upon the termination of employment and in addition to either wages or benefits earned during the course of employment or generally applicable retirement benefits.

Sec. 225. Any department, agency, board, commission, subdivision, or other executive branch entity or official of this state that receives funding under part 1 shall not do the following:

(a) Require as a condition of accessing any state services or facilities that an individual provide proof he or she has received a COVID-19 vaccine.

(b) Produce, develop, and issue a COVID-19 vaccine passport for the purpose of certifying that an individual has received a COVID-19 vaccine.

(c) Provide information of an individual's COVID-19 vaccine status to any person, company, or governmental entity for inclusion in a COVID-19 vaccine passport.

 

DEPARTMENT INITIATIVES

Sec. 251. From the amounts appropriated in part 1 for invasive species prevention and control, the department shall allocate not less than $900,000.00 for grants for the prevention, detection, eradication, and control of invasive species.

 

DEPARTMENT SUPPORT SERVICES

Sec. 302. The department may charge land acquisition projects appropriated for the fiscal year ending September 30, 2022, and for prior fiscal years, a standard percentage fee to recover actual costs, and may use the revenue derived to support the land

acquisition service charges provided for in part 1.

Sec. 303. As appropriated in part 1, the department may charge both application fees and transaction fees related to the exchange or sale of state-owned land or rights in land authorized by part 21 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.2101 to 324.2165. The fees shall be set by the director at a rate that allows the department to recover its costs for providing these services.

 

COMMUNICATION AND CUSTOMER SERVICES

Sec. 408. By October 21, the department shall submit to the senate and house appropriations subcommittees on natural resources a report on all land transactions approved by the natural resources commission in the fiscal year ending September 30, 2021. For each land transaction, the report shall include the size of the parcel, the county and municipality in which the parcel is located, the dollar amount of the transaction, the fund source affected by the transaction, and whether the transaction is by purchase, public auction, transfer, exchange, or conveyance.

Sec. 409. Not later than October 15, 2021, the department shall provide a report on the current and planned future use of the Portage Restaurant at Presque Isle State Harbor in Presque Isle County. The report must include the following:

(a) Loss of rental income since building lease expired.

(b) Maintenance, renovations, and repair expenses since January 2019, including, but not limited to:

(i) Heat.

(ii) Electric.

(iii) Interior.

(iv) Exterior.

(v) Insurance.

(c) Responses to requests for proposal put out since January 2019.

(d) Responses to requests for information put out since January 2019.

(e) Copy of contract provided to potential tenants.

Sec. 410. Not later than November 1, 2021, the department shall issue a comprehensive report to members of the legislature on all lands acquired, or in the process of being acquired since January 1, 2019. This includes the detailed planned uses of the lands and shall include provisions of 2016 PA 288 and 2018 PA 240.

 

WILDLIFE DIVISION

Sec. 507. (1) With the authority vested in section 43521 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.43521, the department may discount the price of antlerless deer licenses to $5.00 for deer management units 452 and 487 to achieve a harvest or management objective for that species.

(2) From the funds appropriated in part 1 for wildlife management, up to $505,000.00 from the general fund shall be credited to the game and fish protection account to supplant lost revenue that would otherwise be collected from full-price antlerless deer licenses sold for deer management units 452 and 487 pursuant to the fees set in section 43527a of the natural resources and environmental protection act, 1994 PA 451, MCL 324.43527a, if not for the discount in subsection (1). The state budget director shall authorize the expenditure of these funds only upon confirmation of the license discount under subsection (1).

(3) The department may terminate the discount in subsection (1) once the lost revenue from that discount reaches $505,000.00.

(4) If lost revenue from the discount in subsection (1) does not exceed $505,000.00 by a date to be specified by the department, the department shall then terminate the discount in subsection (1) and allocate the remaining funds to costs associated with testing deer for chronic wasting disease that were harvested outside the areas designated by the department as chronic wasting disease surveillance areas where check stations and drop boxes are available.

(5) The department shall implement subsection (4) in a form and manner prescribed by the department.

 

FISHERIES DIVISION

Sec. 601. (1) From the appropriation in part 1 for aquatic resource mitigation, not more than $189,500.00 shall be allocated for grants to watershed councils, resource development councils, soil conservation districts, local governmental units, and other nonprofit organizations for stream habitat stabilization and soil erosion control.

(2) The fisheries division in the department shall develop priority and cost estimates for all projects recommended for grants under subsection (1).

Sec. 602. As a condition of expenditure of fisheries management appropriations under part 1, the department shall not impede the certification process for water control structures on Michigan waterways. The department shall fund from funds appropriated in part 1 all non-water-quality studies or requirements that the department requests of either of the

following:

(a) The department of environment, Great Lakes, and energy as a condition for issuance of a certification under section 401 of the federal water pollution control act, 33 USC 1341.

(b) The Federal Energy Regulatory Commission as a condition of licensing under the federal power act, 16 USC 791a to 825r.

Sec. 603. The department shall produce an annual report detailing the performance of its fish hatcheries by March 31.

Sec. 604. (1) From funds appropriated in part 1 for fisheries management, not more than $100,000 shall be spent for a pilot program that allows an individual to use trotlines or juglines on inland lakes and rivers in this state to take nongame fish and snapping turtles. The pilot program established under this section must do all of the following:

(a) Prohibit an individual using trotlines or juglines from doing any of the following:

(i) Using live bait.

(ii) Setting a trotline or jugline within 600 feet of a dam.

(iii) Using more than 10 trotlines.

(b) Provide that an individual shall not set or use a trotline or jugline unless the name, address, and telephone number of the individual owning the trotline or jugline is marked in legible English on the trotline or jugline.

(c) Require that juglines are labeled with a reflective marker that encircles the juglines to allow for visibility at night.

(d) Require that an individual using trotlines or juglines do all of the following:

(i) Check the trotlines at least once each day.

(ii) Remove fish and animals caught in those trotlines or

juglines.

(iii) Remove the trotlines or juglines when those lines are not in use.

(e) Require that juglines are attended by or are within sight of anglers at all times.

(f) Allow the natural resources commission to prohibit or restrict the use of juglines or trotlines on certain inland lakes and rivers in this state if the commission, based on principles of sound scientific management, determines that the use of juglines or trotlines should be prohibited or restricted on those lakes or rivers.

(2) If the natural resources commission determines that the use of juglines or trotlines should be prohibited or restricted on certain inland lakes or rivers, the commission shall, before the pilot program under subsection (1) takes effect, issue a report to the legislature explaining the principles of sound scientific management used to make those decisions.

(3) Within 90 days after completion of the pilot program under subsection (1), the commission shall issue a report to the legislature with recommendations on the use of juglines or trotlines in this state.

(4) As used in this section:

(a) "Closed-cell construction" means a solid body incapable of containing water.

(b) "Jugline" means a free-floating device that anchors a single line with no more than 1 hook and whose float material is constructed of plastic, wood, or foam with closed-cell construction.

(c) "Trotline" means a line anchored at 1 point, with more

than 2 hooks and not more than 15 hooks, and not associated with a hand-operated mechanical reel.

 

PARKS AND RECREATION DIVISION

Sec. 701. The department shall publish a bi-weekly report regarding the status of a snowmobile trail connector project in Rogers City being developed in partnership with the Presque Isle Snow Trails, including the following:

(a) A list of individuals, groups, and organizations the department has contacted.

(b) A synopsis of the discussions or purpose for contact.

(c) Pending activity as a result of those discussions.

(d) Outstanding action.

 

FOREST RESOURCES DIVISION

Sec. 802. From the funds appropriated in part 1, the department shall, subject to forest certification standards, prescribe treatment on not less than 70,000 acres, prepare appropriate treatment for not less than 62,500 acres, and offer prepared timber for sale in the current fiscal year, taking into consideration the impact of timber harvesting on wildlife habitat and recreation use. The department shall, subject to forest certification standards, increase marking or treatment of hardwood timber for sale and harvest by 10% over levels of the previous fiscal year. In addition, the department shall take into consideration silvicultural analysis and report annually to the legislature on plans and efforts to address factors limiting management of timber. The department shall provide quarterly reports on the number of acres prescribed, prepared and sold,

pursuant to this section, to the senate and house appropriations subcommittees on natural resources and to standing committees of the senate and house with primary responsibility for natural resources issues. The department shall complete and deliver these reports no later than 45 days after the end of the fiscal quarter.

Sec. 803. In addition to the money appropriated in part 1, the department may receive and expend money from federal sources to provide response to wildfires as required by a compact with the federal government. If additional expenditure authorization is required, the department shall notify the state budget office that expenditure under this section is required. The department shall notify the house and senate appropriations subcommittees on natural resources and the house and senate fiscal agencies by November 1 of the expenditures under this section during the fiscal year ending September 30, 2021.

Sec. 807. (1) In addition to the funds appropriated in part 1, there is appropriated from the disaster and emergency contingency fund up to $800,000.00 to cover department costs related to any disaster as defined in section 2 of the emergency management act, 1976 PA 390, MCL 30.402.

(2) Funds appropriated under subsection (1) shall not be expended unless the state budget director recommends the expenditure and the department notifies the house and senate committees on appropriations. By December 1 each year, the department shall provide a report to the senate and house fiscal agencies and the state budget office on the use of the disaster and emergency contingency fund during the prior fiscal year.

(3) If Federal Emergency Management Agency (FEMA) reimbursement is approved for costs paid from the disaster and

emergency contingency fund, the federal revenue shall be deposited into the disaster and emergency contingency fund.

(4) Unexpended and unencumbered funds remaining in the disaster and emergency contingency fund at the close of the fiscal year shall not lapse to the general fund and shall be carried forward and be available for expenditures in subsequent fiscal years.

 

LAW ENFORCEMENT

Sec. 901. The appropriation in part 1 for snowmobile law enforcement grants shall be used by the department to provide grants to county law enforcement agencies to enforce part 821 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.82101 to 324.82161, including rules promulgated under that part and ordinances enacted pursuant to that part. The department shall consider the number of enforcement hours and the number of miles of snowmobile trails in each county in allocating these grants. Any funds not distributed to counties revert back to the snowmobile registration fee subaccount created under section 82111 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.82111. Counties shall provide semiannual reports to the department on the use of grant money received under this section.

Sec. 902. The department shall provide a report on the marine safety grant program to the senate and house appropriations subcommittees on natural resources and the senate and house fiscal agencies by December 1. The report shall include the following information for the preceding year: the total amount of revenue received for watercraft registrations, the amount deposited into

the marine safety fund, and the expenditures made from the marine safety fund, including the amounts expended for department administration, other state agencies, the law enforcement division, and grants to counties. The report shall also include the distribution methodology used by the department to distribute the marine safety grants and a list of the grants and the amounts awarded by county.

 

GRANTS

Sec. 1001. Federal pass-through funds to local institutions and governments that are received in amounts in addition to those included in part 1 for grants to communities - federal oil, gas, and timber payments and that do not require additional state matching funds are appropriated for the purposes intended. By November 30, the department shall report to the senate and house appropriations subcommittees on natural resources, the senate and house fiscal agencies, and the state budget director on all amounts appropriated under this section during the fiscal year ending September 30, 2021.

 

CAPITAL OUTLAY

Sec. 1103. The appropriations in part 1 for capital outlay shall be carried forward at the end of the fiscal year consistent with section 248 of the management and budget act, 1984 PA 431, MCL 18.1248.

 

ONE-TIME APPROPRIATIONS

Sec. 1201. From the funds appropriated in part 1 for chronic wasting disease (CWD) testing, the department shall make at least 1
